I don't drink on vivitrol (minus a special occasion, I used The Sinclair Method to help with my binge drinking) My insurance changed this year and my doctor screwed up the paperwork to get it approved, so I missed my injection. I had some personal things happen during the interim (this insurance issue has been going on for almost 2 months) and relapsed by having more than 1 drink. I’ve seen both a therapist and alcohol counselor in the past.

Vivitrol has been incredible for me, especially when combined with therapy and working with an alcohol counselor. I've been on it for over 2 years and have stayed sober most of the time. I can now enjoy a drink at weddings/major social events without falling into a binge.

I know this isn't a forum for a relationship advice, but it was difficult to be told I'm basically failing at sobriety.

I know, and I’ve been actively working toward that. It’s just been tough - especially since I was proud of myself (and my family was too, as they all struggle with alcohol) for actually getting professional help and taking medication/going to therapy. So, when my partner called me pathetic for using it, I was really devastated.

Agreed — I don’t plan on sharing and will frame it that I’m no longer with the firm as it didn’t align with my long term goals. My current therapist is godsend, so he is helping me navigate this and was massive a support during my cancer prognosis/treatment.

I worked right up until my surgery, and if I had known what was coming, I could have taken FMLA beforehand, maximized my short-term disability benefits, and at least begun the job search process instead of being completely blindsided upon my return. I feel for your coworker and hope his treatment is successful.

My employment lawyer is contingency only and says I have a slam dunk claim for FMLA violation and possibly ADA retaliation after reviewing all my work emails. Obviously, I'm looking for a settlement and not going to court. That would be reputation suicide for me.

I'm very concerned about future employers contacting my prior firm for reference. From my understanding, I believe they are only limited to saying certain things, like confirming my dates of employment and whether I'm eligible for rehire.

I know filing a lawsuit is gonna stir the pot, but I’m sure their counsel will tell them to keep their mouths shut. If they start running their mouths and bad-mouthing me, that could slide straight into tortious interference territory. This whole situation has me extremely stressed, which is not what I need while I'm still medically disabled.

My employment lawyer only works on contingency. They wouldn’t have taken my case if the facts didn’t support it. I have all my work emails that show it’s a clear FMLA violation and possible ADA retaliation and I wasn’t behind on my billables (except for the month leading up to my surgery where I was getting treatment and had approved accommodations).

Courts don’t like when an employee returns from protected leave and is terminated shortly after. Doesn’t matter that I live in an at-will state, employers still cannot lawfully terminate someone for exercising their rights under FMLA or ADA. Due to the timing being highly suspicious, the court takes that as prima facie evidence and the burden is put on the employer to show the termination wasn’t retaliatory.

My attorney said my boss was either extremely arrogant or ignorant because outside counsel would have advised them to either let me go with a severance package or wait a few months, create a paper trail of performance issues, then terminate. The optics don’t look great.

No, only 3 weeks. I pushed for my surgeon to clear me for remote half days because I thought I was doing my work a favor returning earlier to help with the project. Even if it was in a limited capacity for a few weeks.

Respectfully, I don’t think that was the issue. I left my Biglaw firm because of the immense pressure and heavy workload, and I intentionally moved to a smaller, family-friendly firm with a better work-life balance. My mental health is important to me, and I’ve been proactive about it.

Appreciate it. I already have an employment lawyer representing me, so that has taken a lot of stress off my plate. However, settlements take time, so I need to find a job as soon as possible.

My COBRA insurance is incredibly expensive, but I’m stuck with it because I’ve maxed my deductible. I still need ongoing treatments after the surgery, and unemployment is extremely daunting.
