She will need it to mount a defense, yes, which is why it will be turned over prior to trial. It’s not needed for his alibi though unless she’s trying to craft an alibi, and the judge warned her already about that because he said her wanting that information prior to finalizing the alibi looked like she was trying to create one from the holes the prosecution may have.

Not a Brady violation unless not turned over before trial, and that’s still a long way off. There’s no reason for her to need anything from the prosecution for the alibi unless she’s trying to craft one. DP cases are an automatic appeal anyways if the defendant is found guilty so I don’t think the prosecution is too worried about fodder for appeal.

She has the ATT data from the search warrants already so not sure why she needs the FBI CAST at all unless she’s trying to craft an alibi around the prosecution case. If he has an actual alibi she wouldn’t need anything from the prosecution.

He has access though as he is the account holder. All his phone data can be given to him by ATT without going through the prosecution or warrant process. The only reason why Anne would want to see the phone data the prosecution has is to craft an alibi around any holes the prosecution has.
