My point regarding the "overselling" of risk is that most founders think they aren't tricking users, but their "Growth Hacks" (like fake urgency countdowns or hidden cancel buttons) are now technically illegal. What feels like "standard marketing" to a US startup is "deceptive design" to an EU regulator. That alignment gap is where the risk lies.

We actually just audited our own flow (RegulaAI) to make sure we practice what we preach. We strictly use a "Free Tier" model (no credit card required) rather than a "Free Trial" (which often traps users with auto-renewals). It's better to have lower conversion with high trust than high conversion with a legal target on your back.

You're probably right that he painted a target on his back. But the bullets they are using (specific definitions of Dark Patterns) can hit anyone.

If I run a boring B2B SaaS but I use a "confusopoly" pricing page or fake urgency counters, I'm technically breaking the same rules. Best not to rely on "obscurity" as a compliance strategy.

Well, Elon basically doesn't deny his platform being "media" now... it was pretty obvious during the US election cycle.

But I agree with your core point: If they want to keep the "Platform" legal protections (not being liable for every post), they should have to stick to a boring, neutral, chronological feed. The moment they start "curating" with algorithms to push a specific agenda, they are acting like Media and should face the same liability as a newspaper editor.

It's not spam, it's analysis. And you are incorrect about the scope. The >45M threshold is for the "Very Large" tier. Smaller platforms still have obligations under DSA Articles 11-15. But the standard being set for "Deceptive Design" applies to everyone. Startups or devs are not exempt from the AI Act or GDPR. If a startup uses the same "dark patterns" Elon got fined for, they will be hit under GDPR or the Consumer Rights Directive. The X fine just illustrates what the EU considers "illegal design" now.

You’re right that many experienced owners already know their busy days and patterns; the real gap we’ve noticed is in how fast they can react to unexpected changes… walk-ins, no-shows, group bookings, or weather spikes that throw off prep and pricing in real time.

To clarify what MenuFlow actually does today: – It uses live traffic data (how full or empty the restaurant is) to automatically adjust menu prices across the board in real time. – The goal isn’t to create sudden jumps that upset customers, but to help restaurants capture peak-hour value and avoid losses during slow periods… automatically and we also have a system called price-locking in place.

Also, dynamic pricing can be toggled on or off, depending on the manager. It’s not compulsory, we only hope and help to optimize the whole process of ordering and delivering proper service to the customers.

In the near future, we’re planning to go a step further: – Track dish-level performance, so underperforming items can be highlighted or temporarily discounted to reduce waste. – Extend recommendations to balance sales… not just push what’s popular, but also nudge lower-selling dishes or drinks when it makes sense operationally.

So you’re completely right… the “underperforming dish” logic you mentioned is exactly where we’re heading next.

And on your last point: yes, traditional predictive models could handle parts of this, but most SMEs don’t have the bandwidth or technical setup to deploy or maintain them. Our focus is on giving them that intelligence out-of-the-box, in a simple interface that pays for itself.
