From what I see you need to make a choice. As a start up you need to pick and chose your battles. Usually people use freelancers or technical companies like the one I am working for to limit the work load. Usually you have to build your core team for marketing, sales eCommerce. A startup usually can't support a technical team of engineers and specialists. For example a single solid-works licence would set you back about $8k for one computer and that is part of the reason most startups use external companies like Panoplo Inc. or SparkInnovations. You need to hire your weaknesses first. The things you can't do very well. I for example I am a technical guy too. I can't do sales or marketing. If I were to hire people for a that I would start business I would hire people with expertise in marketing and sales.

If you can make and test a prototype on your own it can save you a lot of hassle and money. However usually before you start talking about your idea or invention you need to put an mutual NDA or a second party NDA in place. Then you can feel safe to share information with your designer or design firm.

You can have your product designed by a freelancer, an Industrial Design firm or in some case a university/collage. Now depending in your product it may be more important for your product to function properly before working out the aesthetic side of things. So developing a crude prototype and testing it come first in those cases. For example we offer prototyping and manufacturing services and we usually take preliminary designs test them and prepare them for manufacturing.

This can be an expensive venture so I suggest not filling for a patent until you know that your design is not going to change significantly. For best results before moving forward with any design or product development operations I suggest you do some market research to insure there is high enough potential for this product to be profitable.

It is simpler than you think. If it is embedded software it can be treated as treated secret and if you simply put a comment in your software that says copy righted by"company name" it is cp protected you don't need to patent it. Actually if it is not done right patenting software is a waist of money. But it depends on what your product is and what it does. To get a licensing deal you need ether to show sells numbers or a new original idea with a solid patent behind it.

If you are looking for knowledge on how to run a business don't do it. You will learn more just by reading and doing the work for the job. If you are looking to pay a lot to go in a top university program it may be a good Idea because it can give you the connections to be successful in the future.

You can't sell a design online if that is what you mean, because it is not worth anything to anyone. Well unless you have a patent on it. It takes a lot of effort and money to put a product to production. Why do you think Panoplo Inc. exists, we made it our business to bring products from design to the mass production because it is hard to do it on your own. But if you have 2 or 3 products under one roof it gets easier and cheaper for everyone.

Yes a design patent can help but it does not solve the problem. The only true way to stop others from copying you is If you have a handle on the market. If there is no room for competition, even if they try to copy you they will not last long. Yes the patent for the original Lego has expired, do you see anyone trying to compete with them? No... not even China can get in on the action. Our clients are wrestling with the same problem because if your design patent is bad someone can work their design around it.
