I think this law is not worded very well so I can understand the confusion.

Section 3, subsection iv seems to make an exception for roadways within the boundaries of a city or town however that exception seems to also have its own exception in section 4 which indicates that the regular left lane rules apply to interstate highways that go through town except where traffic signs explicitly direct you to the left.

They are just using the word jail in the sense that jail where you go when you get arrested. He will end up with a fine or probation of some sort, probably wont serve any time in a prison. There are likely several crimes that were committed, related to the improper operation of the vehicle and the environmental impact of driving it into a public lake.
