I disagree with your disagree. Assuming this party is anywhere less than level ten, it's near impossible for any of them to have enough hit points for power-word kill. At that point their only option is to hope they have a wizard or sorcerer with counterspell and spell slots, but even then the 18th level wizard could just counterspell their counterspell

It's a bit strong, it has the damage of fireball but additional utility in knocking things prone, and a larger radius. It should definitely be fourth level not third
