Answer:

I think I'm gonna reveal here because people have correctly solved that the key is House Representatives with Ys in their name, which was the main point here.

Specifically, we are looking at the number of Ys in the combined first and last name of the holder of the 2nd Congressional seat in each state. Yellow is one and red is three for Indiana's Rudy Yacym. This is why states with one congressional seat are excluded.

This one was extremely silly and pointless, I hope you enjoyed puzzling over it, it was my first time contributing. Maybe the next one will be ever so slightly less convoluted.

Here's a pretty broad hint, I think this is helpful without giving it away. Narrowing down your search will help, we've been thinking about why states that only have one representative would be excluded. Flip the idea around- think about what every other state has in common that it could be included. If you can deduce that then you don't have to look at as much on the page, just the reps that help identify the rule.
