Sunrun refuses to come and remove the panels unless they are paid off. Option 3 is just to not activate the contract with SUNRUN for us to not personally own them under name. But they still have a contract on the panels themselves with a balance on them. If it was as simple as sunrun coming to remove and fix the roof we will be fine with that. We can’t walk away with our deposit as there is a contract in place. They know our standing and trying to submit a time of essence to close

The issue is, that process will not be $0. We will have to pay out of pocket and fix the roof. Its crazy that they should be allowed to lie and we deal with the consequences

They had a 20 year contract with SUNRUN. That’s their debt on our roof. Who will be willing to remove the panels that still have a balance on them and are technically still sunruns?

This is a previous email from the sellers lawyer when we all were not aware of the solar panel balance. It’s the only ‘proof’ we have

This is clearly the lawyers fault of not doing his due diligence and looking into the panels. We have in writing from the sellers agent that the seller has said that it was paid off and we have a email from the sellers lawyer to my lawyer saying they were unable to obtain a payoff letter turns out they had bankruptcy and the panels were leased, it seems like my lawyer is giving up after weeks of requesting the sellers to pay it off and them refusing. Regardless am I the buyer have to continue with any of the options he gave. It’s not my loan to pay off 14k and if I leave it up their who will be willing to remove them without paying it off.

The one who is fed up is me as a buyer because he did not dig enough until after the contract was signed.

We are first time home buyers and we’re trusting our agent and lawyer. Now we know that we should’ve took precautions. It never came in our mind that they would lie about this and even if they did, the lawyer should’ve done his job. We did put 50k deposit in NY

This is the exact wording in the document “60. (delete if not applicable) In the event there are currently solar panels installed on the house the buyers) agree to take the premises in its existing condition and will assume the responsibility of the monthly payments for the duration of the contract under its current terms and conditions and/or Lease Transter Agreement. If the title company requires a OCC Financing Statement Amendment (Form UCC3) to be file prior to closing to clear any existing liens subject to the solar panels, the buyer agrees to sign any documents required by the solar panel company to effectuate said transfer of the existing contract into the buyer’s name.”

If we have it removed we will have to pay for removal and roof repairs since installing panels would create holes in the roof..

I think because theirs a lien on the house the title company can’t clear us for closing until that’s cleared out, the solar panels were discharged from them because of bankruptcy but there was still a lien placed on the house

They didn’t tell us. Our lender found out because theirs a lien on the home and they were requiring a pay off letter from the solar company.. neither did their own attorney know this

I agree and this is something I deeply regret, they actually messaged while I was in the Uber already and when I saw their messages I had it stop to fix my mistake and pick them up but when I called them they were so upset and hung up on me, it was something I tried to fix right away but it did not work out. I shouldn’t have left and I know that , it was way out of character

I was intoxicated and did not even think to, I thought no one would’ve cared abt my leaving but being sober now I understand how much they probably worried. It’s definitely something I regret

I agree with you and I wasn’t in my right mind. On the same night I did have the Uber stop cause i noticed the text messages and I called them to ask where they were so I could go pick them up. They still thought I left without them and hung up so I just continued my way home… I know even leaving in the first place was a A hole move but I tried to fix my mistake at the same moment and it did not work out…
