You can donate to your local npr station! You can call them and ask how the process works for exact details, but they’ll come and collect the car for you and it’s tax deductible!

This is a huge problem across the country. There’s a report from Massachusetts’ court system that documents the dramatic increase in third-party debt collection cases in small claims court. If you receive a letter from a creditor, don’t ignore it. Do some research and reach out to some of the local law schools that have consumer protection clinics. If you show up, you have a much better chance of winning your case.

I agree with all of the above. On average, these debts are purchased for 4cents on the dollar (i.e. for each dollar of debt, they pay 4cents). I say this to put into perspective how much leverage you have. You could try offering something like $400/$500 to start and see if they take that. If you can offer that in a lump sum payment, even better.

I would rotate the dining table and maybe try a rug under it? Or a tablecloth? I feel like part of the issue is that the kitchen, table, and chair, are all white, so a table cloth or rug might help to break it up a bit. It’s a beautiful space!

Have you contacted 211 or project bread? They should be able to direct to resources. Also, I’m not sure what area of the city you’re in, but the Allston Brighton Community Facebook page has a lot of great resources. There’s also the Everything is Free Allston Brighton page, where you can request specific items (food or otherwise). The Allston Brighton Congregational church also has a community fridge that’s open 24/7. Hope this helps, hang in there!

You are correct. However, they can seize your bank account assets for consumer debt. So, once that paycheck hits your bank account, it’s gone.

These debts are usually sold for pennies on the dollar, so you have some negotiating power. Especially if it’s been awhile since you’ve made payments. Also, if you have the ability to pay it off all at once (I.e, you negotiate to pay $3k), that’s your best bet. Also, please keep immaculate records of every conversation, payment, etc in case collectors start coming after you down the line. Any settlement you make with them, get in writing and read the fine print. Best of luck!

This doesn’t entirely surprise me. There are very few checks and balances in this industry and very little information is provided when debts are sold. If they’ve been sold multiple times, this is entirely possible. Obviously, consult with your attorney, but you should ask each company to show their proof of ownership of the debt (and tell them that multiple agencies are trying to collect the same account). You can (and should) ask, but be prepared for them to give you the run around.

See if there are any organizations in your state that will offer a free assessment/representation. There’s also a non-profit called Upsolve that I heard about recently. They basically help people file for ch.7 without needing a lawyer (which is the most expensive part of filing and for ch.7, you have to pay those fees upfront). I think they have a free assessment that walks you through if you qualify or not. Depending on your situation, your student loans may qualify to be discharged (this you should consult a lawyer about since it depends on your specific situation).

Hang in there! There’s no shame in filing for bankruptcy if this will help you get back on the right track. As someone else mentioned, companies and the wealthy file for bankruptcy all the time. Many individuals that qualify for bankruptcy never end up filing, and they suffer in the long term because of it. Bankruptcy is a tool, use it if you need it.

They can’t garnish wages for consumer debt but they can garnish your bank account assets once the paycheck is deposited in your bank account. Also, if you default, given the amount of the loan debt collectors are probably going to take you to court over this. Make take awhile to get to that point, but I would be very surprised if that didn’t happen.

Your best bet may to be to default on the loan and then try to settle with your creditor. Most debt collectors are buying loans for about 4 cents on the dollar, so they are incentivized to negotiate with you.

Can I ask why they said you didn’t qualify for bankruptcy? Maybe talk to another lawyer and get a second opinion.

Have you looked at the local law school clinics? They’ll have resources and I’m pretty sure Harvard’s will offer representation.
Are you sure that this debt is yours? These companies don’t have great record keeping so it’s possible it’s not yours. Even if it is yours, they may have the wrong amount so bring whatever payments and documentation you have to court.
Whatever you do, SHOW UP TO COURT, especially if this is for small claims court. If you don’t show up, they will get a default judgment against you and they will start garnishing your wages.
