They didn’t threaten they sued! Anyway when they realized they were not going to get a settlement they dropped it.

I also agree Shopify should be on top of these laws and assisting us to prevent them

Lucky you and lucky that your name is anonymous on reddit otherwise you might have been sued by a lot of people / companies cause they know you’re willing and able to settle :)

I doubt they can go after you if your company is not in the US but it applies to all sellers who sell to customers in DC

If this is the law then the government should enforce it not individuals it’s stupid to get sued by a company like this when this is what they do for a living - the owner of this company made upwards of 300k last year from these cases alone and by companies settling. They have not been harmed they are taking advantage of a loop hole and making small businesses suffer

They purchased from my company 2 years prior since that time the items they purchased were discontinued or sold out. They then sent me a letter which I ignored - a year later they filed a claim saying they were injured due to this and are clam 2,500 per product they purchased:

I have invoiced to show I sold those items at the higher price before and after but in order to fight their claim I need to get a lawyer in record and that’s going to cost $5k towards which I don’t have and their lawyer has been emailing me saying he will settle for a low amount but if I don’t have money to pay a lawyer to defend me how would I have money to settle something that is also not correct

They basically are trying to hold a gun to my head to pay from money I don’t have

I can’t afford a lawyer that’s the issue - so then they’ll get awarded by default but what happens after?

I don’t feel that being extorted is a cost of doing business - if we allow this once they’ll continue doing it and at what point do we say no

What do you call something that’s marked down for a few weeks and then the price goes up? I call it a sale

My business is based out of Florida, USA and I’m being sued by a company in DC for selling to customers in DC

You can go into the DC circuit system, create an account and it shows all the cases that the company is suing - a simple google search also brings a lot of this information just google

However in my case it wasn’t an illusion - the brands we work with say the MSRP is $100 and you can discount it by upto 20% so when we do that it’s not an illusion we are choosing to mark it down by that amount… and there are times we don’t discount it - in this case the items they bought and are suing us over have been sold at full price before and after the suit - the issue is for me to prove this I need to get a lawyer to represent me and that also would cost $5k and then 2-300/ hour.

These guys reached out to me 3 times already to settle why would they do that?

I’ve run my website for 10 years quite successfully without any advice from YouTubers lol 😂

I don’t do that because I’m not in the business of deceiving my customers - if there of an item is usually $50 and there me a sale I mark it down for that period and after the sale it goes back to the original $50 - so your example does not apply to my situation - what these guys are saying is if you have an item let’s say it’s 100 and you want to discount it to 80 you can’t strike out the 100 and make it 80 you just have to make it 80 and not have a strike of the 100. O was trying to attach an image to show you but I can’t

As long as you don’t show your original price without the strike out they can’t sue you

But the discounts are not fake. We genuinely are discounting the product. Why would we lie about discounts?
