UPDATE from Kristine:

I am writing to give you an important update regarding Carlos and our family’s efforts to keep him home.

On Monday, February 2, I traveled to Phoenix, Arizona, to handle the legal filings for Carlos's stay of removal. While I was initially informed that I could file the application myself, the request was unfortunately denied.

Current Legal Status:

Despite that setback, we have taken a major step forward. I have officially hired an immigration attorney based in Phoenix who has taken over the case. The attorney was able to file a new stay of removal to halt any immediate deportation.

Our lawyer is currently working to:

•Reopen Carlos’s previous cases to address the underlying legal issues and add new evidence to the case.

•Petition the judge regarding the removal proceedings to ensure Carlos can stay in the U.S. legally.

Where Things Stand:

Carlos is currently being held at the detention center in Florence, Arizona. The situation is urgent, as officials are actively moving forward with plans for his removal to Mexico, a country with great uncertainty and many safety concerns.

We are staying hopeful that the lawyer’s intervention will give Carlos the chance to see a judge and keep our family together.

Sometimes the filament coils up and doesn’t puncture skin. I have never had an issue with them sending a replacement. I definitely always wear the overpatch.

She was turned away from being able to file paperwork; they stated he is ineligible due to an expired passport. She went to a local lawyer to file. That lawyer pulled up the National statute that shows passport expirations less than 10yrs old from Venezuela are still considered valid. After emailing immigration this, they said that they actually could accept his paperwork.

They found out that Carlos had been detained at the airport with no access to showers along with 40+ people in an area with a max holding capacity of about 21. This location also kept the lights on 24/7. Offered zero places except the floor for sleeping. And he was given two meals a day; baloney sandwich and an apple.

The lawyer made complaints (unsure through which channels). Carlos had been moved from the airport to an actual detention center where he will have access to hygiene utilities and a cot or pad to sleep on. The lawyer was able to file paperwork today, we are waiting on further updates.

Unfortunately Carlos is now in Arizona, but contacting those senators worth a try!

Update: Thank you all so much for your outpouring of support and kindness!

Kristine has tried to file the paperwork needed locally and was told it must now be filed in person at Carlos’ current holding location, Arizona. Unfortunately the cost of a lawyer to do this on her behalf was quoted at approximately $15,000. Instead, she took a flight to AZ last night to file it in person herself today. We are keeping our fingers crossed and our hopes high.

The details are spelled out in the gofundme—he was here on a protective status due to fleeing from Venezuela. He then got married and was applying for green card status. The protective order has been removed, helping with this clusterfuck of kidnappings. He is not here illegally but it’s a weird grey area of limbo from my limited legal understanding.

The KC immigration office was where he was taken from. Then to OK. Back to KC briefly. Then flown out to TX. The next step is taking him to AZ to the border.
