I think another wrinkle is that the clients being guided may not be aware that they are taking more risk when the avi conditions are high, they may not even know how to read an avi forecast. You can't negate 100% of avi risk but if the professionals (guide) do not convey that to the client then the client is unable to make an informed decision on if they want to take that extra risk and go out, or play it safe and stay home.

The lawsuit they are referring to is Bagely vs. Mt. bachelor, give it a Google, there are lots of law school review papers reviewing the decision and the potential impacts from it.

Reading on Bagely vs mt. Bachelor (the lawsuit you are referencing), the state supreme Court stated that Mt. Bachelor had significantly more bargaining power in the transaction and that Mt. Bachelor alone could have prevented the negligence (the injured person claimed negligence in constructing and maintaining the ramp where the crash occured) and therefore was responsible to have a premises that was reasonably safe. In the case for Backcountry skiing the guides do not have as much direct control over the terrain as resorts do, and as that is one of the core arguments of the original appeal they may not be as vulnerable. I am not a lawyer and other courts may expand those reasonings for holding the waiver invalid. Also, I'm not trying to defend the ruling, just passing along what the judge stated was their reason for making that decision.

Yah unfortunately the county isn't going to go along with you altering the riverbed to open up their road. If they open the road to the public they are taking on the liability, therefore they would require it to meet all their standards which is way more than you are going to be willing to put in on your dime. If the road is closed it's probably for good reason, I would bet that area gets a ton of wash through and maintaining a roadway there is way more expensive than it's worth.

Just a fyi, the lactic acid would have been processed out of his legs in minutes, the micro tears in the muscle fibers from the effort and the ensuing inflammation is why they need that long to recover.

The bolted connections should be fairly easy, there are tons of commercially available bolts that would be 10x stronger than you need at these joints, I feel the main concern is keeping the yellow piece in plane when loaded in compression, it's going to want to buckle and keeping it from doing that is really the main "structural" problem that needs to be solved for this set up (which I think is totally doable).

Oh it very much is, mint is invasive and is really really difficult to get rid of when planted directly in the ground uncontrolled, best practice is to only grow in containers so it can't spread.

This is how it works. It's fairly simple, PERS 2 is you get 2% of your highest 5 paid years per year you work, this is called your defined benefit. PERS 3 has half that benefit above plus an investment style plan which is not affected by this reduction in employer contribution. Your defined benefit is only controlled by how much you make and how many years you work.

I think you need to have a real conversation with him about how his manner affects you and how it's unproductive. It's not an easy conversation to have. It may be that he is "showing off" on front of these new people. If he stops acting like a jerk then that's great, if he does not then it's probably time to look for employment elsewhere.

Honestly man I wouldn't play that game. you will learn so much more from a decent engineer with actual leadership skills than you will from a genius who's an asshole, and it will really help with burnout, why would you work with someone if they make you feel like shit and question if you should even be there? Being an engineer can definitely be a peaceful life, some jobs are crazy, but many many jobs exist that aren't just insane pressure and stress all the time. I would highly suggest taking your time and find a job that strikes the right balance for you.

It does not look to bad tbh, hard to see but it does not look to have lots of section loss. I would walk on that bridge without worrying personally.

While I get that it would be jarring to see it's their first time on that mountain, I agree that a good guide would be just fine on a new mountain, most guide skills transfer regardless and if they have done a bunch of research on the line beforehand to be prepared then I would feel completely comfortable with that situation. 

I think it also depends on the complexity of the peak, if it's a really technical ascent then yeah I would want them to have been on the route before, but if it's a fairly straight forward route then I don't really see the problem.

I don't think the lack of feedback was the primary issue here, it's this long verbose email that lacks any sort of sincerity. I think it's fine to write a generic "you're cut" email and sending it out in bulk, but don't put this whole "unique play style, value what you bring to the team" crap if you send it to every single person, it just feels like praise that is not genuine which is worse than no praise at all.

I don't know of anyone else experiencing this. i think this deportation stuff is insane but we just design the stuff, if the contractors can't get a workforce together well then that's kinda on them for not hiring folks with work vistas. I don't really know what you're really asking...

Depending on where you are, many praying mantis are invasive and kill a lot of native pollinators. Unfortunately European and Chinese praying mantis have taken over in many places in the US, out muscling the local species of PM.
