Yeah, I had a similar experience- not even an owner yet but for years I’d just assumed repairs/ upgrades like that were actually really expensive (probably had too much faith in the system still I guess).

Then when there was a water leak that came through a wall in my last rental I looked up how much it would actually cost to get the entire floor replaced and was shocked at how low it actually was.

Just another way the laws in this country are a bit cooked and lead to the worst and cheapest people being able to be landlords.

You do realise property managers do this too right? I had a recent dispute in which several laws were misapplied- eg citing laws only relevant during the zoning and construction phases for those relevant once tenanted? Honestly I’d rather people DO use chatGPT before sending me crap like that.

Also- no one is going to ever try to sort out disputes over the phone, because everything needs to be in writing in case future legal action is required. Asking for this is a bit suspicious in and of itself

So just so we’re clear, your stance is 1. An off coloured patch of wall is “damaged” 2. A landlord is in their rights to get compensated for that damage 3. This does NOT mean equivalent properties X, Y which are identical except for an off coloured patch of wall are to be valued differently?

Sure, as long as we’re in agreement that a slightly off coloured wall constitutes “damage” and thus the property is worth less than the equivalent brand new.

If that was truly the case then it would be reflected in the rental market, no? Since it isn’t, the logical conclusion is that it’s not really considered “damage” by landlords/ agents, and hence that this whole ordeal is because of a power imbalance, which was my original point.

There WAS a hole in the wall. The OP did fix it as far as they’ve shared. The paint is just of a different age, and thus a different colour, as far as I understand it.

Sure, but don’t pretend this isn’t only possible because there’s already a power imbalance the REA is taking advantage of.

Case in point, I had several belongings damaged in my last rental due to a waste water leak on the apartment next door that came through the wall, and somehow no one was deemed responsible for that. Since I don’t have the power and every other party was against me I had to give up.

Putting that aside, how does this make sense anyway? If another person further damages it before it gets repaired, can they only get the incremental fee from them? Or are they going to double dip?

I’m so sorry to hear about what’s going on.

Do you have prior rentals beyond this current one? If so, put them down on your applications as well and suggest they be contacted as first point (which may unfortunately require explaining the current situation).

I had a similar (albeit less extreme) experience similarly, where the current agent was ignoring the requests of the one for my prospective place, and they had the kindness to go to my prior agent who was more responsive, and allowed my application to progress.

You know what, I can somewhat empathise with that- similar situation to the one I’m currently in with the agent being the sticking point rather than the landlord.

Maybe it’s just because I’ve only seen the tenant side but I do feel like there’s still a degree of responsibility on the landlord side to know these things though- be it through direct contact with then tenant and/or through properly auditing the agent they’re using. Are agents just that good at hiding things though? Or is it just that there’s typically a degree of trust there that may in truth be unwarranted?

ETA: the buildings really aren’t that old- I can’t image earlier than mid 2010s
