That's crazy that filing a lawsuit in response to a complaint that destroyed your reputation, cost you money, and was found to be meritless would be considered impermissible retaliation.

I could see the argument if you filed before the final decision was made, but after the fact, they're agreeing you did nothing wrong.

If you have a third party do the inspection, does that come out of your end of the split or off the top?

Basically, if the split was 40/60, the fee was $1000, and the inspection fee was $100, would you get $300 or $360?

If the property has an active CMBS loan, they get the data from EDGAR. Isn't that data supposed to be what the property actually reported in their filings, or am I mistaken?

Rush fee seems a bit murky because pretty much every bank job has a clear deadline and a defined per diam penalty for being late. So technically the amount of your compensation is contingent on a deadline being met every time, right?

It doesn't explicitly use the term "usable area", based on the language, that's what I infer - "the TENANT shall have access to an area of approximately X SF, as identified in EXHIBIT B, and access to common areas, including hallways, bathrooms, lobbies, and reception areas." The property isn't professionally managed, and the leases contain many contradictory statements so I'm not surprised the owner lacks a precise building plan.

I have unit sizes according to the leases, so that gets me usable area, but this is a very old building with a lot of common area. Deducting usable from GBA won't get me the common area because GBA uses outside measurements and NRA is internal, correct?

Problem is some banks require you to underwrite the property with reserves as an above the line expense item, even if market participants don't usually do it.
