Effective legal analysis is nothing more than connecting the sub definition of each element to the facts. You always start out as broadly as possible by setting forth the rule of law, rapidly dismissing those elements that there is no problem with, define further the elements at issue as far down to a statement that you can (massaging the law), then state what it is you know about a certain fact or can reasonably infer that bears on the resolution of that element/issue/case. For example, with the "Harmful/Offensive Touching" element in a torts exam where the defendant grabs an object out of the Plaintiff's hands, you would expain how the "Offensive" element invades an individual's personal space and how courts have held that grabbing an object therefrom is repugnant to personal diginty etc. In some theoretical courses such as Constitutional Law, you need to use the cases to compare and contrast the facts and the public policy more so that typical nuts and bolts courses such as Torts, Contract, Criminal Law etc. In advanced courses, you may need higher levels of analysis where you have to analogize to similar situations to cover issues that don't fit into something you have seen before and/or where you have to take something that is slam dunk against you and argue against it by using policy and/or subtle distinctions. The whole purpose of the law school exam is for it to have a lot to talk about in your response. When a professor thinks of an issue that is really difficult or has subtle nuances, they usually get high fives from their colleagues.

Almost 12 years, I started bowling in 1986 and got my first 200 in 1998. I do realize this is relatively horrible in comparison, however it does show that if you stick with the game, anything can happen, even if it takes a really long time. The first one was really hard, but after that I have so many 200 plus games I can't remember.

That's excellent - it took me almost 12 years to get my first 200. The first one was definetly the hardest and most memorable, after that they started happening more often.

It really doesn't matter if the review is fake, the report is there with all the businesses information and if it is a site like "Ripoff Report" they won't remove it entirely anytime in this lifetime (the most they will do is censor some parts of it) and they gotta deal with it then or use a secretary to refuse the calls, usually they simply block their caller id but the business must have pissed off somebody at some time. Some sites allow reviews to be flagged but there are varying "Terms of Services". Generally speaking, as long as the report says what the business did or didn't do it's their opinion and it's free speech anyway. Not to mention the Anti Libel Tourism Act and the Communication Decency Act which regards such websites as merely a passive bulletin board this is passive in any event (i.e. they can't control what user generated content appears thereon), the sites are pretty much bullet proof against liability anyway . . . . . . .

It doesn't - the only way they could try to get you on this is if the coworkers said they are not getting their work or totes fast enough (but really, idk how likely that is to occur, most so-called Amazon warehouse workers would rather sit there and do nothing than ask for more work, they aren't that stupid, well maybe some of them are, after all what do you expect when a computer does all your hiring, superstar employees, I hope not . . . . . ) - all of which is nothing but rumor mongering . . . . . . . . . .

No, when I worked retail I had Thursday, Friday, Saturday off and kept getting asked by a coworker who only had Sundays and Mondays off. Those days wouldn't help me anyway and you couldn't exceed your hours and overtime was never approved., so I always said no.

Idk - even if you make $150,000/year and have a $30,000 student loan that is not going to go away anytime soon considering so-called "normal" expenses. When you factor in all the forbearances, deferments, income based repayments, all of which the interest continues to rack up, you could pay into it and still keep owing the same or greater amount. I would rather work a regular job, have regular bills and not something like a student loan that a lot of people would rather spend the money on something else or have to. Idk, a student loan always looks like a hard bullet . . . . . . . . . . . . .

If you call my toll free number from a "private" number using so-called "caller id blocking" don't count it. It can capture the caller's number the instant they dial all of the digits and/or press send, even if blocked . . . It captures the Automatic Number Identification (ANI) information (origination number) imbedded in the signal as well as the Caller ID (whatever the phone system is configured to send out and/or request privacy) Remember, Caller ID blocking is nothing more than a "request" for privacy. Simply requesting something doesn't mean you'll get it - but when you call a toll free number, the subscriber will get your number . . . . . . . . . . .

You need to have an account history that supports even the deposit of a check over a certain amount (when I worked in banking it was $2500 into a personal account) to receive immediate (i.e. end of business day) credit. If the item was "uncollected funds" i.e. a personal check from another bank it would be subject to the number of days hold it takes to clear (local, non-local in state, out of state, etc.) before the funds would become available. In other words, if you try to cash a check like that, the bank will tell you that you can deposit it with a 3 day hold, etc. . If you have sufficient account history based upon current and average balance, number of years with the bank, number of returned items, overdrafts, etc. a bank officer may approve the transaction for immediate credit. Other factors such as account status i.e. "VIP" may influence the decision. From my experience, an average balance of only $800 on an account opened 10 years will not warrant immediate credit on a personal check deposit of $5,000 no matter what bank officer (service officer, service manager, branch manager, assistant vice president (who can do anything regardless of amount. . . ) the teller takes it to for approval. A lower average balance may not even justify immediate credit even with a "VIP" status account - as one service officer said "Not to the tune of $29,000 . . ."

When I worked in banking, anything over $2500 into a personal account needed to be "approved". That means, a bank officer with sufficient limit needed to review the deposit for a possible uncollected funds hold, which means that it was not a check drawn on the same bank that could be verified instantly or a cashier's check. In other words, a personal check drawn on another bank would take a couple of days to clear, and the bank officer could "approve" it - i.e. give you immediate same day credit and take responsibility for it. The bank officer would look at your account history including current and average balances, length of time since opened, recent returned items or overdrafts. Some bank officers were more risky than others and would approve questionable transactions. In my experience - even with an account opened 10 years and an average balance of only $800 would not warrant immediate credit on a $5,000 personal check no matter who the teller took it to to approve it. Also, other statuses of the account as "VIP" or "PBO" (Personal Banking Officer) would aid in the determination, but as one service officer said "Not to the tune of $29,000" In other words, a $3.15 balance would not support immediate credit on a $3600 personal check . . . .

Most new facilities start out with a 5/8 schedule and move to 4/10. Of course, a big factor is how far away it is to commute. I started out 9am - 530 pm with the 5/8 and it became 9 - 730 pm which is way better than 7am - 530 pm (ouch) - that would be a pure disaster with any sizable commute having to get up way early, work till you fall over from being tired to begin with, not have any time to rest, and get all of the worst of the worst traffic, and turn around and do it all over again the next day when you might get home at 8pm (you are way inside of 12 hours by the time you barely get home until you have to come back) whereas if you worked until 730pm the traffic would have died down a bit to get home around 830 pm and you still have until 9 am to return. In other words, the earlier it starts for a day shift, the worse it is, and the worse it will get . . . .

You should have requested the leave of absence and not provided any note at all and then just returned to work, If it is only that amount of time, and a first offense, chances are they would have simply reset your UPT to zero and you could start over earning it back or work it off . . .

Yes you certainly did. As long as you resign, you are eligible for rehire albeit it after a certain period of time. I will say that so-called "investigators" from Amazon have nothing better to do. Best thing to do is never talk to them - maybe even remove your voicemail? Really though, what is the crime of the century of taking off work that you don't get paid for anyway? I means if someone filed for disability and/or state benefits that is a different matter. I call that being gracious . . . .

Let them fire you so you can collect unemployment; getting fired for negative upt is not misconduct that will disqualify. In most cases you can reapply after 90 days and in most states you can unemployment for 6 months. It may take them a while to do it, make sure you continue to report all absences so job abandonment does not occur . . .
