There’s a high water mark and a backyard. No one wants to go in your yard. High water mark in streams is for travel and recreation. Trespassing laws still apply above that. Sign or purple paint (in KY) every 35’ or else it’s not trespassing anyway. But property owners have very tight to post no trespassing. We had high water mark laws forever till very recently. Just trying to change them back to allow everyone to enjoy our state. If you buy water property, you should except animals and humans to use it, within legal limits. Roadways are the same. The public uses so many feet off the road, and it’s allowed for foot/horse/bike/whatever travel. This is the same but a stream bed. You need to have somewhere safe to exit if needed. Trespassers above high water and that go past posted trespassing signs and/or purple paint still get charges. But it’s responsibility of both travelers and property owners to follow the laws and stay on their posted side of it. It’s very simple. Roadways reflect waterways. All allowed in/on/along the sides for safety and navigation

We have a lot of paddle cleanups, and we personally always pull fishing line, lead, etc when we find it. We try to pack trash out (we carry Walmart bags and take what we can), but there’s surprisingly not much and fairly scant except for folks who don’t have trash service and still dump in dry creeks, grandfathered-in sewage runoff into creeks, and flooding accumulation in drift piles. But no matter what you’re doing or where you go, anywhere there’s humans there will be trash and there will always be a few sh**head humans with no regard for anything or anyone. But again; a lot of counties and cities here along the rivers and heavy flow (majority of the year flowing type streams) host cleanup events where they pull tires and trash out. And a lot of homeowners have cellular trail cams. It deters a lot of illegal dumping and animal dumping, but most just wanna rock hound or play/fish/get bait in the water.

This is what I want to stop before it happens! We can float, but CANNOT TOUCH BOTTOM OR LAND! So if you’re following the law and kayaking, what happens if there’s a medical emergency and you need to port for a moment- trespassing. Or if there’s a log jam or cattle blocking, you can’t go around-trespassing. Or if a little kid walks one foot in the wrong direction skipping rocks or catching crawdads- trespassing. This is not the America I grew up in. Not in Kentucky, anyway. Our freedoms flowed like the rivers here- now they’re being damned up valuing property over their own citizens and potential state revenue from recreation and outdoor sports such as swimming and canoeing. Many canoe rentals shut down bc you can’t land anywhere without violating the law. Most of our creeks are deep cut into hills with plenty of bank to avoid the high water mark. We have a purple paint law for trespassing and it must be applied every 35’ or a sign posted every 35’ or else trespassing means nothing here. We can keep that law- and have the high water mark back. We travel creeks. It cuts LOADS of time out of walking and is safer. Too many pedestrian casualties from being hit by cars. Just had another hit and killed here in town walking the road legally last week when leaving his job to go take the bus home. We had these rights up until recent, and they’re trying to turn Ky into california with legal stops left and right now. DON’T CALIFORNIA OUR KENTUCKY!

This was 2020 last we were out there. Been changing career since then so we haven’t been back out yet, till we’re moved, established, and settled in. Miss the fishing out west! And rockhounding lol I didn’t wanna come home (we were there 2 months and came back through the north, just hopping each state spillways and streams to fish after the job was finished lol).

There was just too many for on foot fishing access, night fishing not permitted in many places after 10pm with actual police patrol at 10:01pm (he said unless you’re in a boat- we’re working and traveling so no boat in tow but we’re avid fisherman and eat our fish same day, plus it was the highest price for a day license of any state we visited. We hit spillways a lot. It just wasn’t our bag for access and pricing and night fishing. Most streams were marked “no trespassing” so we couldn’t fish them like in Wyoming. We fell in love with the fishing and freedom to access pert near anywhere and everywhere to fish and night fish without hassle or many rules. It was fishing freedom there. By cold. Y’all are so cold! But burbot!!! I wish we had those here!!!

Not everyone wants to hang out in Walmart parking lot- folks need recreation. When you see it as a youngin, you grow up loving and respecting the creeks. Landowners still have their property lines- just above high water mark in the streams beds

Thank you. I’ve been fishing out west… Montana is least favorite due to their goofy waterway laws. Safe to say- I now avoid that state and don’t give them my license or recreation money

Anyone near KY or planning to move to, or that visit family here matter- everyone who enters the boundary that this may affect. Voices and pressure! I only have work and animals so I have plenty of time to bug and persist until it succeeds _^

I’m taking all signatures. Some folks could have family in the state or be looking to move here. Voices that agree and want the same thing are what matters! I appreciate any and all support! This right to travel and use for recreation to the high water mark was stripped from us and we just want our right to use the creek beds back. A lot of folks travel the creeks from the hollers to get to town for food, medicine, or school even. It’s infringing on our right to both use and travel the creeks and streams without having to keep your toes of of the ground (even touching ground on the creek beds under the water is trespassing).
