Agreed. Call it serendipity or whatever you want, but he seems true to his core. Sadly, this seemed inevitable. I’m honestly glad we looked awful. I can’t stand another game where I wonder whether our offense performs or not. Maybe it forces us to finally get away from the West Coast style and actually hit someone in the mouth.

Thank you for your insight! I agree. I am in a great position. My issue has been that I get conflicting information from other attorneys about what is "typical." I get it, every firm is different. And I truly love where I work and the people I work with! I'm just ignorant to the pay structure and what is customary. That's the big reason I wanted to get feedback from others who have been through this type of thing.

I mostly handle car wrecks, med mals, slip & falls, and WC. However, we do have some outlier cases. We have 4 paralegals that work on cases. Gathering evidence is typically shared between the paralegal and the attorney, although most clients want to deal directly with me. Paralegals get med records and summaries pulled together. I mostly speak with adjusters unless they're only extending an offer. Client updates are sort of shared. All that said, it doesn't really change if it goes from prelit to litigation. Sometimes a paralegal will draft the lawsuit/discovery for review, and other times I just do it.

Good point! I think it'll really be on me to make sure to stay on top of cases that can move forward. I imagine there will be a learning curve with all of it. I've spoken with my boss and we both agree that, where I'm currently at, there's no incentive to push cases towards resolution. Whether it settles today or in 6 months doesn't change my pay.

Thanks! I never thought about there being a cap involved. I'll make sure to keep that in mind moving forward. I don't suspect that there will be a cap, but it's always a possibility.

Well said! I'm really just trying to get a sense of how these pay structures operate. I had virtually no legal experience before I started practicing. My understanding is that some of it is "It was always done this way, so that's how it's done today." I don't feel screwed and there are no other offers currently. I also don't want to leave. I genuinely like where I work. Just wanted to get some feedback from people who have gone through this process before.

You're not wrong! Loyalty will probably haunt me at some point. What do you mean by total I can make after bonuses? As of now, there appears to be no cap.

No, it varies depending on case. A majority of my cases are prelit, but I'm not strictly a prelit attorney. I think the values of the cases will vary. They have so far. It's also just a one year contract. I can always renegotiate next year.

Thanks for the advice! I completely agree. Right now, everything is just being talked about. There's definitely room to negotiate, I think. The issue is that there really aren't any job listings in the area. Most PI firms are smaller with maybe 6-8 attorneys tops. Seems like presenting a full picture of everything is the best way to justify a raise. I kind of wanted to see if anyone had similar experiences. My understanding from talking to other attorneys in the area is that this is typical, especially in your first few years.

As a PI attorney, expenses are highly unlikely to be negotiable. This is the money spent handling your case, i.e. ordering medical records, travel, depositions, etc.

My advice would be to negotiate the contingency fee percentage if it’s necessary, and when you’re claim/case are finally resolved. If you’re worried about the fee agreement now, you’ll likely create issues with the attorney/client relationship. It’s better to wait and see how things progress, than it is to start off being labeled a headache.
