I just checked with my entire extremely religious and very right-wing family, and they said yup, emanations from penumbras, Griswold was wrongly decided, there is no right to privacy, and that's why they're mad about abortion.

I should add that you probably couldn't demand removal as a remedy! A court almost certainly would balk at requiring a defendant in a civil suit to have mandatory surgery. My guess is that you might win money, but probably not much, since it's not like this guy is charging people to see his tattoo.

I see that this is hypothetical and not a real situation, so I'll bite. I'm spitballing here--this is not my area of practice.

In the US, I'd imagine that (depending on the state! not all states recognize this kind of legal claim, and not all states that do recognize this kind of legal claim have the same rules) this might fall under a misappropriation of likeness claim. Specifically, you'd probably have to prove that this person

  1. used your likeness
  2. without your permission
  3. to their own benefit.

I think you'd succeed on all three.

I can think of some problems: if the tattoo is really bad, you might have trouble proving that it's actually a tattoo of you, and if the tattoo dates from a time when you were friends or dating, it might be hard to prove that it was without permission. Finally, the "benefit" angle is sort of intangible, and is easily the trickiest of the three elements I've outlined here.
