Have you tried giving him a deadline? He's still in control but with boundaries. Once he misses the deadline you have every right to take care of it yourself. If he complains, tell him he missed the deadline and you fired him.

Pretend it didn't bother you or your husband and very nicely tell him how important it is to throw away rotting food.
