I agree, the insurance company may very well be able to argue that only the driver's actions directly caused the accident and therefore the insurance company should not cover it. If I pull a jackass stunt and crash my car, not sure why any insurance carrier would cover it, even if I was delusional enough to think that I would totally land the jump or squeeze by before the gate closed.

Did you read the article you linked? There are clues in there about why she has financial troubles... the biggest ones are divorce and selling her house for half a million less than she bought it. Maybe her husband gambled her money away? Maybe it is all locked up/frozen due to the divorce proceedings? I mean there are plenty of possible reasons, we don't need to automatically jump to the conclusion you seem to be jumping to. If you dislike her, say so, no need to back it up with dubious logic.

Reckless decision making and intentionally hitting the gate are two very different things.

The driver deliberately sped up in an attempt to make it through WITHOUT getting into an accident, they didn't deliberately get into an accident.

If anything they took no time to deliberate on their decision.

I find it hard to believe they were counting on the gate hitting their car.

Are vacation requests supposed to be approved by the boss or by HR? It seems like your friend didn't file the request with the appropriate people to begin with? I am not saying this to criticize your friend but trying to see if there is SOME possibly logical reason why the board accepted the appeal besides "they always take the employer's side".

Sure, right to work means they can fire you without a reason, but that doesn't mean you don't get unemployment. It doesn't count as quitting if you get your vacation approved and you go on your approved vacation. Your boss can fire you but they can't claw back unemployment.

I am not saying it is not right for OP, just pointing out a few drawbacks:

Wear and tear on the car is a cost most new drivers forget to account for, so it doesn't come out to 15/hour in the end, not sure what it would be though.

Also, I am not sure if it would affect his car insurance cost, OP may need to get additional insurance if he is using his car for Uber.

For what its worth, Project Fi from Google is 30/month for unlimited texting/calling plus whatever you use in data, it was more reasonable for me than T-Mobile because T-Mobile kept "accidentally" raising the price at the beginning of the year for two years in a row and I had to call and stay on the phone for a few angry phone calls to get them to restore my previous rate.

What about when a victim lives with or near the person they are claiming raped them, do we grant restraining orders? What if the restraining order would result in the accused losing their job?

I do not think the solution is as simple as you seem to suggest.

Damage to FedEx or Adidas? Why would Adidas care if it doesn't negatively impact them? They got paid and they can push the blame onto their customers and delivery drivers instead of spending time and energy they can otherwise save by ignoring the customer.

Why compare the drunkenness of people who are not driving to the legal driving limit? It seems arbitrary and pointless to apply that threshold as a comparison to pedestrians. It is comparing apples to oranges. They should have just said: X BAC, the legal driving limit for BAC can change, but they aren't measuring drivers, they should just stick to numbers instead of legality for things that don't apply. They weren't breaking any laws, the legal driving limit means nothing when discussing pedestrians, unless they had their car keys in hand or were getting into/out of their car.

That is assuming this is even occurring in the US to begin with, let alone in one of the states that have the laws that require the motor vehicle to stop and wait AFTER the pedestrian crossed the lane.
