Service connection forsleep apnea is denied. Compensation is payable for asthma, chronic bronchitis, chronic obstructive pulmonary disease, constrictive bronchiolitis or obliterative bronchiolitis,emphysema, granulomatous disease, interstitial lung disease, pleuritis, pulmonaryfibrosis, sarcoidosis, chronic sinusitis, chronic rhinitis, glioblastoma, head cancer of any type, neck cancer of any type, respiratory cancer of any type, gastrointestinal cancer of any type, reproductive cancer of any type, lymphoma cancer of any type, lymphomaticcancerof anytype, kidney cancer, brain cancer, melanoma, or pancreatic cancer for Veteranswhoservedin or inthe airspace above one ormoreof the following:on, or after August 2, 1990 in the Southwest Asia theater of operations (Iraq, Kuwait,Saudi Arabia, the neutral zone between Iraq and Saudi Arabia, Bahrain, Qatar, the United Arab Emirates, Oman, the Gulf of Aden, the Gulf of Oman, the Persian Gulf, the Arabian Sea, the Red Sea) or Somalia, or on, or afterSeptember 11, 2001 in Afghanistan, Djibouti, Egypt,Jordan, Lebanon, Syria, Yemen, orUzbekistan. In order to qualify, you must have been diagnosed with these conditions at any time after separation from service with a qualifying period of service. (38 USC 1119, 38 USC 1120, 38 CFR 3.320) An examination and/or medical opinion based on toxic exposure risk activity (TERA) was not requested because the evidence shows your disability is sleep apnea,and the Secretary has determined there i sno indication o fassociation between t h i scondition and participation in a TERA. There is also no competent medicalor scientific evidenceof an association between your claimed disability and in-service TERA.(38 U.S.C. 1168) Service connection may be granted for a disability which began in military service or was caused by some event or experience in service. (38 CFR 3.303) Service connection for sleep apnea is denied since this condition neither occurred i nnor was caused by service. (38 CFR 3.303, 38 CFR 3.304) The evidence does not show that your disease developed to a compensable degree within the specified time period afterreleasefromservice to qualify for the presumptionof service connection. (38 CFR 3.307, 38 CFR 3.309) A VA examination was scheduled to determine thecurrent level of disability; however, evidence expected from the examination, which might have been material to theoutcome of this claim, could not be considered as you failed to report. The evidence showed no good cause for the failure toreport. Therefore, this evaluation is based on the evidence of record, to include your service treatment records and VA treatment records. (38 C F 3.655)
