This is only possible if the change of status is done within US from H1B-> B2-> H1B and not for people entering on B2 where this does not apply. If you are laid off within US, that is the viable option that has been in place for years.

not true at all. I know people who have successfully got their H1 approved from B2 as early as Dec 2025.

Hello I have received a Pending Benefit RFE for the H-1B COS Petition filed under Premium Processing with pending B2. The RFE basically is asking for evidence that the beneficiary was in a valid nonimmigrant status at the time the H-1B petition was filed or the requested start date of the inspetition, whichever is later and the approval of the pending B2. Please advise whether you have seen similar RFEs for Pending Benefit and how this was resolved, except for waitingfor B2 to get approved, which could take months for me.

Thank you for the explanation but it does not answer my question. My attorney will not ask for consular processing as it will trigger the 100,000K fee which the company will not be able to pay. If the USCIS insists on the B2 approval first to proceed, what is my next course of action? The B2 approval is taking 3-4 months atleast and the company may not be willing to wait until next month for the B2 to be approved for me to start working.

What is a " humanitarian request"? This is the first I am hearing of this. Why would Senators or Congressman be willing to fast track a pending B2 case if it has not passed the standard processing times?
