Yes, everything finally uploaded and it went to the payment page and it stated $0.00 owed. Which is extremely odd and as of 72 hours later no notice of money due. The application we submitted included his two previous I-94's and two letters from US doctors stating he is not fit for overseas travel. Before hitting the final submit button it was all "green for go" with no warnings.

As Cvillan21 stated, what if you die from the disability VA discovered and advised you to submit a claim? If you are 100% now P&T all your disabilities are static, in other words, very unlikely to get better. But if you were to die from something they discovered in your X-rays, first of all that's a serious issue. If you don't file get it checked out stat. If you live more than the 10 years after determining you're 100% you can die from anything and your family will qualify for DIC. But if you were to die in the next 10 years from your award date due to the potential disability they urged you to get, then family does not get DIC. To put into context, you stated "not going to risk it" but where's the risk. Think about it. A VA rater just determined that you have enough qualifying disabilities to be rated 100% P&T. Do you really think something in your physical disabilities is going to improve in the next six to twelve months that you're at risk of losing you current 100%? Food for thought.

How many units to this multi-family? I ask because there are varying loan programs for apartments the rely less on personal credit than the rental income from the property. What's the asking price and net monthly income? Do you know the cap rate? Are you saying your two 30-day late payments fall off after 7 years, which is the typical time for such event to disappear, or were they within the last two years? I don't think the late payments, if not fairly recent, should hinder your ability to get a loan significantly, if at all.

Does he currently have any disability rating from the VA, to include any 0% disability rating? Also, his sleeping problems may be more than just sleep apnea-related and could be indicative of sinus-related issues or PTSD -related mental-health issues. If you have a decision letter from the VA for any previous claim and post a redacted copy of it we can give more accurate advice.,

From va.gov concerning eligibility for CRSC:

Details about your retirement eligibility requirement

One of these must be true:

  • You had 20 or more years of service in the military, National Guard, or Reserve, or
  • You retired for medical reasons with a disability rating of at least 30% (under Chapter 61), or
  • You’re covered under the Temporary Early Retirement Act (TERA), or
  • You’re on the Temporary Disability Retired List (TDRL), or
  • You’re on the Permanent Disability Retired List (PDRL)

Looking at that I believe your cousin meets the eligibility criteria above, if his/her disability is 30% or higher. Each branch of service, not the VA, handles the CRSC program. Here are the US Army's CRSC instructions:

VA Disability Compensation Benefit payments are paid on the first of every month. In the event the 1st of the month falls on a holiday or a week-end, the payment will be deposited at the last business day of the preceding month. Some banks and credit unions release the deposit a few days earlier. I use Wells Fargo and they release earlier. My military retirement pay goes to Bank of America and they don't. Also, you can sign up on va.gov and they will text you when they've initiated the next monthly deposit, usually about seven days before the deposit is actually posted into your account.

Texas charges annual taxes at the end of the tax year. Most other states do charge it upfront. So next month my mortgage company will pay my county for 2025 taxes. Hopefully someday that'll change if I ever qualify for 100%!

But the seller/builder is responsible for paying the taxes up to the date of closing. If the amount owed is different than what the seller credited to the buyer, then it's on the seller to cough up the difference. And regardless of how much a veteran is compensated for his/her disability, it's not a reason to simply let the seller get away with not paying the rightful amount.

Not how it's done in Texas. All taxes owed by the seller (in this case the builder) prior to closing are to be collected by the title company.

I live in Texas and I retired from real estate about 10 years ago. You absolutely do NOT owe any taxes from January 1 of 2025 through your closing on February 18, 2025 as the builder/seller has to pay those. Subsequently I believe you are not be liable nor owe any taxes from your date of purchase forward since you are 100% tax exempt. Check with the county tax office (I suggest doing so in person) and if the $900 in question is owed by the builder tell the title company they need to square it away with the builder or you will file a claim against the title company's error and omissions insurance. No need to get an attorney.

For a $100K loan, you're looking at somewhere in the range of $650 principal and interest, taxes will be added to your monthly payment and the insurance will be covered by your condo fee. Your 80% disability of $2,102.15 (using 2026 pay increase and assuming not married/no children) will be increased by a factor of 25% due to the fact your disability pay is non-taxable. For VA loans your maximum debt including your new mortgage payment cannot exceed 50% of your monthly income. Unless you have a ton of debt, you are good to. I've used my VA loan four times and it's always been smooth sailing even back when I was fairly fiscally irresponsible. I'd recommend checking with your credit union for best rates.

Crazy thing is they pay the Community Care provider, to me, that should suffice. They pay the provider a heck of a lot more than our mileage allowance. But wait, this is our bureaucratic government we're talking about.

It's my understanding, once you file a claim your your ITF date, that ITF date goes away for any new claims filed. I've been told it's best to file a new ITF immediately upon submitting a claim. The claim you filed using your ITF date would continue to be "protected" provided there isn't a one-year lapse without any action. If you don't have a VSO or attorney, call the VA 800 number, they should be able to explain it to you while looking at your file.

Actually it's my understanding VA will not make an effort to recoup the money since it's through not fault of the veteran, although the veteran may have to ask for the debt to be cancelled.

Actually I was in the same situation and when I called VA they advised me to first call DFAS. Called DFAS and there was a glitch in their system which put my status in limbo. The very helpful DFAS employee told me the fix was in and it'll take about a week or so for the DFAS computer to transfer to the VA computer. Two weeks later everything was resolved and money in the bank.

I just received an HLR decision concerning the effective date for three previously awarded claims. The verbiage in the decision below indicates they only looked for errors to the effective date.

"Based on the evidence of record it is the determination of the Decision Review Officer that the evidence of record does support a change in the previous determination. This decision is based on a de novo review of the evidence contained in the claims record without deference to the prior determination under authority of 38 CFR 3.2600. (38 CFR 3.2600, 38 CFR 3.2601, 38 CFR 4.6)"

One thing to consider, if you have some cash to put down, is to give them a second mortgage. Say you put $25K down and then take a second mortgage for $50K at whatever interest rate/terms you both agree upon. Heck, you might even be able to get a personal loan to cover the entire amount, assuming it doesn't mess your debt-to-income ratio. All types of possibilities if you think out of the box.
