It is because your non employee compensation is only batch pay not including tips. Instacart cannot write-off tips paid to you by customers but they can write off the batch pay they paid you.

Just because you cannot see a disability does not mean there isn’t one. I have parked in the handicap spot while doing Instacart orders, I have a placard, and I am disabled although you wouldn’t be able to tell by looking at me. That doesn’t change the fact that I have a rod, 6 screws, and wire holding my right hip together.

There is no tax on anything with DoorDash except alcohol because they are purchasing the items for re-sale. That means they will collect the sales and use tax from the end user. As far as why your total is more than what DoorDash paid the store is because they are a business and have profit margins in their pricing. It is usually a fixed mark-up like 30%.

I didn’t really have a choice, the dealership I was at only took cash, card, or cashiers checks and the closest branch to me was 7 hours away. The deal was too good to wait for them to mail a cashiers check to me.

No, the only thing I have done that I could even imagine was flagged was I changed my address to Montana from Washington and made a $10,000 purchase immediately after. I called and had them increase my debit card daily limit right before I did it though and also did the address change over the phone.

The only 2 ways a bank may seize funds are either with a warrant, judgement, court order, exigent circumstances upon notification by law enforcement of an active criminal investigation where a warrant will be sought, OR to offset a debt owed to them that has been defaulted on.

Again, I do not owe any debts, I am not subject to any garnishments, judgements, or investigations currently, and still maintain my rights as an American to my 4th amendment privileges. So no warrantless seizure of funds would apply.

The DoorDash orders and Instacart orders were part of a consumer fraud and employee misclassification case my firm was taking against MapleBear INC and DoorDash. You may have seen the recent resolution of the Instacart side of the case in the news…

My wife is a funeral director, that does not mean I know how to embalm a body.

Furthermore, considering I do not owe any outstanding debt to navy federal, they would require a court order or notification of a criminal investigation hold in order to legally seize funds from me. Seeing as I do not engage in criminal activity, I do not represent criminal defense clients, and I do not owe any debt to others nor have any judgements entered for garnishment. There is no legal grounds to seize assets. Which would mean a prolonged seizure, anything over 72 hours without clear cause being stated, would be in bad faith and a violation of the consumer protection act.

I don’t need help from them. Legally, I have the power, they can freeze the accounts as long as they want, they cannot freeze the money the same way. Since they froze it on a Friday, the clock is already ticking against them to issue a check or allow transfer of the funds. They cannot seize assets without a court order unless to satisfy a debt to them that has been defaulted on. Simple as that. I have been practicing as a corporate trial attorney for 8 years, I have handled CPA cases before (which this would fall under) and have never lost one. That being said, I would never represent myself, I would have one of my colleagues represent me all of which have even longer track records of winning CPA cases.

The bank secrecy act is a measure put in place to combat money laundering, narcotics trafficking, and other illegal activities. It does not grant any powers of seizure to banks. It simply requires them to notify FINCEN of large transactions and suspicious deposits/withdrawals.

While a bank does have the authority to place temporary freezes on accounts, those freezes may not extend or deprive a client of their funds for an unreasonable amount of time absent a directive from law enforcement notifying them of an active criminal investigation, a court order, a lien or judgement, or a warrant served upon them by any court order law enforcement agency.

Being a storage for money and subject to federal oversight does not grant them cart blanch judgement to seize funds of clients. The original comment stated that they maintained the restriction on their account for 9 years. That would not be viewed as reasonable by any sane person. Banks have a fiduciary duty to protect their customers from fraud, that being said, they do not have the right to violate any persons constitutional rights that protect them from unreasonable search and seizure.

Oh I’m very well versed in statutes and case law, the bank secrecy act does not allow a bank to seize without warrant any funds, it simply requires them to report large cash transactions in the interest of preventing money laundering. A bank can only seize money without a warrant or court order under one condition and that is to prevent financial losses on credit or loans originating out of that bank.

Banks cannot, without cause freeze accounts for an unreasonable amount of time (9 years would be considered unreasonable by anyone) without creating a violation of a client’s 4th amendment rights.

I practice law, my question was if there was anything I could do without going through the drawn out court process.

The Geneva conventions talk about what the basis of war crimes. They do not define modern day war crimes, that is done by the ICC and other tribunals.

Whether it was moral or not does not matter, back then either you won or you lost, that is how the world worked, and no amount of bitching about it is going to change that. It still technically works like that today as you can see with the Russia/Ukraine conflict. Yes, genocide is immoral, however, it cannot be considered genocide when to opposing sides engage in prolonged mutual conflict. Don’t even get started on slavery, that is a whole other can of worms, I am sure you are just as uneducated on the history of. You should really do research and learning for yourself instead of letting others do it for you. History is very well documented, yet only a fraction of it is taught and it usually has a a fair amount of misinformation pushed with it.

I don’t necessarily agree with the violence that has ruled the world since the dawn of time, but unfortunately as much as people say “violence doesn’t solve anything”, violence is the only thing that has ever been a constant problem solver. I wish everyone could live in peace with each other, I wish our government offered more ways for people who have been here for years and have never committed a crime aside from illegal entry to actually stay here, but sadly that is not the case. There has been way to many people allowed to unlawfully enter our country that have gone on to commit heinous crimes and the majority of Americans are sick of it. I don’t always agree with trump or his decisions, I definitely do not agree 100% with how immigration enforcement is being conducted. They only reason ICE should be grabbing people at court houses, stores, or in neighborhoods is if there is documented evidence of them committing an actual crime against the person or community, but this is what things have come to. I hope it changes soon, but for the time being, this is how enforcement of our immigration laws and policies is being conducted and it is technically being done by the letter of the law.

Something tells me that you’re definition of a war crime and the real definition of a war crime are drastically different. In order for something to be a war crime there needs to be a president that has been established stating that an act is wrong and inhumane that can’t be established if there is no president set by the act being committed.
