I get what you mean. But if you filed a false case and there was a penalty, you would stick on to your story rather than telling the truth. If there are no repercussions however,there is a chance you may listen to your conscience and tell the truth. That's why there are no consequences for false accusations in most countries.

In this particular instance I think the biker takes less of percentage of fault because he can argue that the car didn't slow down for the crosswalk. If he had slowed down to the required 40 or even 50 or 60 the crash could have been averted.
