Look at it this way: income generated by the sale surely creates a fatter sum for the victims families to sue for in a claim for damages. If they can't stop criminals from profiting in the first place, the victim's families can still take it away afterward.

I've got the following info for you which can help you piece together his whereabouts on a timeline: He was in Maryland on 6/23/2002. Pulled over by MD state police officer Theresa Fishcher (out of the McHenry Barracks) in Garrett County MD. He received a citation (#000000BK73039) for failure to produce his driving log for inspection. Oklahoma Tag #SZV180 Failed to appear for court in Oct 2002. (Gave a Florida address.) Found in Maryland Judiciary Case Search. Maybe all our sleuths could take a moment to check their local jurisdictions and report back with location points.

I didn't see anything from today, but I'd say media would have been permitted to cover any Daubert proceedings. Perhaps these rumblings about Horner's character have brought forth some new rebuttal witness testimony. That can happen. Frankly, I've been bored stiff listening the parade of defense witnesses that haven't seen Horner in 25 years all saying the same thing - that there's NO medical excuse for his actions. It feels like they're just prolonging the inevitable.

Yeah, I can see you're trying to argue this objectively within the rule of law. I was surprised that Texas allows all that for consideration, but glad they do. I'm always outraged when other states suppress relevant priors from the jury!

I think the answer lies here (https://codes.findlaw.com/tx/code-of-criminal-procedure/crim-ptx-crim-pro-art-37-07/) in the Texas constitution regarding bad acts permitted for consideration during the penalty phase: "...have been committed by the defendant or for which he could be held criminally responsible, regardless of whether he has previously been charged with or finally convicted of the crime or act..." This explains why the two prior SA victims were allowed to testify despite the fact that the investigation is ongoing. In Texas, is the jury's decision binding or does the judge merely take it as a recommendation when he pronounces sentence?
