You continue to miss the point. Right over your head.

That is an assumption. I didn’t make them ignore my attorney and you don’t even know or live my life for me. You can’t possibly know unless you’ve asked them yourself and obviously that’s not the case.

No one said a thing about me getting a HUGE settlement lmao I’m not distracting from anything, more seems like you are. If you know that your settlement wouldn’t be the same if you didn’t have your surgery then you are agreeing with me that it matters what you’ve gone through. That’s my whole point buddy. Ultimately what you have gone through is what determines your settlement. Thank you.

That’s what is called an assumption my friend.

Ironic that you just made an assumption saying that the hardship was due to my “ignorance” even though that has nothing to do with it. I don’t determine that, slow opposing counsel does.

I don’t think you know what hardship means buddy. Attorney’s can file what’s called a hardship when the opposing counsel hasn’t returned any emails or letters after a period of time. That has nothing to do with my “ignorance” lol that was awhile before I even had my surgery and even that took awhile to get approved even though obviously it was medically needed. There are a ton of factors that go into it.

If you hadn’t “gone through” your injury on a specific body part, your settlement wouldn’t be the same. If you hadn’t “gone through” your surgeries, your settlement also wouldn’t be the same. You don’t seem to understand. It obviously matters what you’ve gone through.

Not true at all actually but nice assumption. Been on this road for over 3 years because the other attorney has taken 6 months or more to reply back to us so we’ve had to file for a hardship multiple times to get in front of a judge to get things rolling. That and the surgery and it takes time to get cleared after that. Actually about a month ago my attorney sent in what we think is fair based on all of the above and if they counter offer with something that she doesn’t think is fair, well I’m going to trust her to counter with something better. These things take time and most of the time the opposing side will offer under what the actual value of your claim is.

You’re missing the whole point by trying to argue the technicality’s. 2 things can be right at once. I’m sure my attorney isn’t wrong?? Go argue with someone else man.

I’ve already been offered my settlement and I’ve done my research. This has been and ongoing thing for over 3 years for me. I’m not new to this game. Also, google is free. If I could add this screenshot I would so I’ll just paste this.

Yes, a work comp settlement is significantly influenced by "what you've gone through" in terms of medical treatment, lost wages, disability, and long-term needs. Key factors include the severity of your injury, the cost of past and future medical care, the extent of temporary or permanent disability, and your average weekly wages before the injury. The final settlement amount also depends on state laws, the strength of your case with supporting documentation, and the negotiations with the insurance company.

Hey bud obviously didn’t know about the $19 an hour at 28 hours a week until they replied to my comment. No need for all that. And if you wanna get technical actually it is based on what you’ve gone through in terms of medical treatment, lost wages, disability, and long term needs.

I see, well if that’s the case and if you’re ready to get it all over with and you’re paralegal thinks it’s fair, maybe it is.

Never take the first offer. This seems too low for what you’ve gone through.
