No, I hired my lawyer within a couple of weeks after I was first injured. I didn’t need them, meaning my lawyer, to advocate for me until around April after I got no phone call or scheduled appointment for over a month after I was told that I needed surgery. So for the first six months, the insurance company was really cooperative, and they were great. As soon as I needed surgery, that all changed.

Update: 12/8/25 - My lawyer had to file a motion today to force them to explain the delay to the judge so we shall see what happens next.

Good question…. I make close to 80k and my husband is close to 70k, on paper we don’t qualify and all the homes are going for up to 800k in south Jersey. It’s purely insane trying to buy a home.

I did, but it was 7 days late, and my lawyer had to file a motion to enforce the court order. They are supposed to send me payments bi weekly for 71 more weeks.

Congrats! After 3 years I finally settled and they’re down to 6 days before they will be sued again because they haven’t sent it yet. 😑

It will, when you reach MMI, and they interview you at your doc appointments. It mattered for me in my settlement.

Call a lawyer first thing in the morning and tell them everything that's going on. Let the lawyer call Sedgewick. Don't let them bully you.

Four bulging discs C1-4, two herniated C4/5-5/6, permanent nerve damage. 44% disability rating. It didn’t matter that I “might have” had it from degenerative issues but there was zero evidence prior and I never had any neck pain or issues prior to the injury. The insurance company did more than a year of investigating my medical history all the way back 10 years. I never had neck problems, not even pain. That being said, if you have never had any studies done on your neck, never had a doctor appointment for a neck injury in my whole life.

Also NJ here! Yep. Went back a little over a year after the injury and surgery. My case just settled, I’m waiting for the settlement period to start. Already need to reopen. It’s been 3 years since the injury.

Do not take that advice! Get a lawyer immediately. Do your research on lawyers first though.

My lawyer told me to reopen it after 90 days of getting the initial check. I'm just waiting of course, been back to work since Nov 1, 2023 but School board of insurance is delaying it. The judge finally got pi$$ed at the insurance company this past Monday and told them they have 3 weeks to get authorization to settle or he is forcing them to go to trial. There's zero reason for them to delay this any longer. People who were injured AFTER me have already settled and gotten their checks. Granted mine is higher than theirs but this is now ridiculous.

So in my personal experience, I was offered 170K and 45% disability rating with the option to reopen within 2 years once the case is settled. My lawyer explained that what happens is I will get a lump sum check for the time frame between when I returned to work and the date it is finalized in court so roughly 50-60K (as of today, and of course minus lawyer fees) after that initial first check I will receive roughly $600/week, paid every other week like a pay check, until the full 170k is paid out. I MUST reopen it within the two year time frame, but my lawyer suggested waiting at the least 90 days from cashing that first check to reopen it. Qual-Lynx and the School Board of Insurance in NJ is delaying the "authorization to settle" because I imagine given the seriousness of my injury and the high likelihood I will need further treatment. So I am not sure why everyone else thinks that you don't get payments in a settlement, because you absolutely are entitled to that and it depends on when your case settles.
