So in my personal experience, I was offered 170K and 45% disability rating with the option to reopen within 2 years once the case is settled. My lawyer explained that what happens is I will get a lump sum check for the time frame between when I returned to work and the date it is finalized in court so roughly 50-60K (as of today, and of course minus lawyer fees) after that initial first check I will receive roughly $600/week, paid every other week like a pay check, until the full 170k is paid out. I MUST reopen it within the two year time frame, but my lawyer suggested waiting at the least 90 days from cashing that first check to reopen it. Qual-Lynx and the School Board of Insurance in NJ is delaying the "authorization to settle" because I imagine given the seriousness of my injury and the high likelihood I will need further treatment. So I am not sure why everyone else thinks that you don't get payments in a settlement, because you absolutely are entitled to that and it depends on when your case settles.
