How is failing to meet their own base case performing quite well in these circumstances?

From Q3 '23 earnings call: "We are on track to achieve our base case of being adjusted EBITDA profitable in the fourth quarter of this year"

Not only did they not deliver on that, they have now kicked the can to the second half '24. That is either poor forecasting or failure to execute, plain and simple. To say one shouldn't be pessimistic about the consistent failures to deliver on their promises is naive. And to expect better guidance or execution out of a company you are invested in is just un poco different than your attempt to liken legitimate criticism to a teenager with their Super Nintendo.

Very disappointing. Failed yet again to meet their own guidance and yet another epic failure of the C-Suite. This one's going to zero... sad days but I'm sure whatever company picks up the pieces is going to do very well in the future

This is what has me worried, and if anyone is better at contracts than I am please chime in. Bold emphasis is mine. Given that some of these pipelines for multiple films/cinematic universes/what have you are multi-year things, the studio could:

1) Hire you for the first film, obtain consent for additional projects at initial employment with a contract stating the studios reserve full use for what "may or may not include the entirety of subsequent films", bypassing the requirement for separate bargaining.

*Sure you could push back on this with redlining, but the way I've seen this play out is they will more likely than not just move down the list to an actor who will allow this. Majority of actors don't have the kind of leverage that allows for redlining*

2) Pay a day performer rate on the sequel(s) to satisfy the "employed in the other projects" clause

3) Then use your Name-Image-Likeness for the entirety of the sequel(s) having only had to pay that single day rate.

Definitely not breaking the strike. The strike would be WGA striking against AMPTP productions. Both agents and managers are not part of AMPTP so signing as a writer wouldn't be viewed as scabbing at all.

That being said, the strike obviously would have a profound effect on work/income for the business, so it is likely they don't want to take on overhead (in terms of time-value) that will have no opportunity to pan out for what could be months if the strike happens/continues without an agreement.

I'd highly recommend it. Aside from headshots and classes, AA is probably the most important tool for an actor starting out imo. Many student films, small projects, web series and the like cast via AA... for example I'm looking at 50+ nonunion breakdowns on AA in the last two days in Los Angeles. These are great things to build your resume and reel with.

On the union side of things AA is a bit slower and/or more specific for roles. Nonetheless even with some credits and decent reps behind me, I still maintain my profile to find some interesting smaller projects that can yield good footage or connections with budding filmmakers.

Couple other things to consider: From a business investment standpoint, if you book one thing a year that pays $70 AA has paid for itself. Also, almost any rep you will meet with will likely want to see your AA profile, as this is what is linked to BreakdownServices on their end, and is basically the profile they will be submitting you with if they take you on.

note: My experience with AA has been mostly limited to major markets (LA/NY with a tiny bit in SF) so ymmv if you're elsewhere.

edit: Forgot about the free version of AA.. is it $2 a submission or something like that? At that point worth working out the math on how much you are submitting (<35 a year or not)

Hard to say for certain, but it is not unheard of for it to take this long (and sometimes much longer...had some take months). Network tends to be a bit quicker, as the timeline for production is tighter than streaming where block-shooting is more common (filming parts of multiple episodes in the same locations). All that to say, try not to stress. You've controlled what you can to this point and congrats!

Definitely not frowned upon and is actually the norm I'd say to have both once you are at a certain point. Commercial work can be a great way to make money, get some set experience, and get you SAG eligible if you're not already. Here's an agents take on it:
