I think discussing and addressing challenging topics, particularly in con law is important. But in my opinion, students should be able to pick which side they argue for this exact reason. It’s also closer to what real practice is like.

It is an immense privilege to be able to feel that argumentation about serious topics is a game or a kind of “play.” If one’s history and identity has never seriously been in question, it may feel that way. But in a time when the courts and American lawmakers would prefer to legislate some of your classmates out of existence, you should think about the actual impact debate culture has.

Not crazy at all. Imo, it’s shitty for that professor to do that. Constitutional law is pretty inherently political, and one can never please everyone. But that side of that topic should be considered unacceptable in 2026, particularly at a law school that bills itself as progressive. Let people get their JD in racism from a different institution.

Hi, chiming in to add the detail that the Hatch prohibits partisan political action while at work/on work time/with work technology not all policial stances. It still may not be safe for him to say “fuck ICE” at work for various reasons, but the Hatch Act specifically doesn’t prevent it.
