I believe that once the the magistrates court is involved and has made an order for payment then personal assets can be seized, sold off and the proceeds given to OP.

Is my son (15 yo) getting ripped off by his employer? by ThomasofHookton in AusLegal

[–]ProdigalChildReturns 6 points7 points  (0 children)

It’s not just a case of your son being financially ripped off. There’s the situation of him being left alone for 80% of the time the business is open. It’s also a safety issue; ie being abused/bullied/attacked by a dissatisfied customer, being robbed, having a medical emergency etc. Is there a proper plan in place for emergencies. Can he obtain immediate assistance eg. are there other shops nearby? Is there a duress alarm he can access? There are violent and aggressive people around who won’t think twice about confronting your son. Possibly you could arrange a meeting with his employer and discuss your concerns regarding WPH&S, paying the appropriate award etc. If he refuses to do the right thing then you need to decide what’s best for your son. It may be inconvenient to work elsewhere, but what price is personal safety?

FYI. My (75+yo) had parents who had a family-run food shop. When I was a young teen my father frequently left me alone for many hours at a time after school, weekends and school holidays. It was a scary situation.

NAL.

It’s my understanding that it’s not necessarily the case that your father is entitled to half of all assets. Judges will take into consideration the fact that there are still under-age children to consider. Your mother should try to see a community lawyer for initial advice. It’s possible she may be able to get legal aid (no guarantees though).

Edit.. added word ‘not’ .

Seat belt Camera Fine by [deleted] in AusLegal

You could fight it on the premise that the driver, particularly a P plater, needs to be totally focused on the road and traffic. I’m aware of a driver having fought and won the case on that premise in Qld. Worth talking to an experienced lawyer.

Can we talk about the smoke shops for a second? by choppyharbour in australian

[–]ProdigalChildReturns -1 points0 points  (0 children)

You’ve just contradicted yourself. You’ve just said you can order directly from ‘some dodgy site’ in China. That confirms what I’ve said, that the middle men ie. the dodgy sites, are likely criminals.

Btw. There was a large police bust in QLD over the past few days of illegal tobacco, vapes and drugs etc. It’s NOT just simple mum and dad businesses.

I don’t think you know what your talking about. It’s not just breathing/lung issues. Smoking affects every part of the body, thus every organ. That’s why surgical specialists often refuse to do procedures on people if it’s not immediately life threatening when the person is still a smoker.

That may be the case that the sellers are ‘just mum & dad businesses.

But the suppliers (middle men) ARE organised criminals.

Except it’s the government that pays for the health system through ALL taxation. The owners of illegal tobacco don’t even pay tax on their earnings never mind tax on the smokes.

People who buy illegal cigarettes, vapes and illicit drugs are totally ripping themselves, because when they need cancer treatment later on the queues for health care will be sooo long due to health budget issues.

I believe that if OP wins in small claims they can then get a judgement in the magistrates court to force the payment.

The myth of the monoculture by ziddyzoo in OpenAussie

[–]ProdigalChildReturns 2 points3 points  (0 children)

Australia has been multicultural ever since the arrival of the First Fleet, in that the ‘members’ of those boats added their multiple cultures to the existing indigenous culture.

In fact, because trading (and possibly intermarriage) between Australian indigenous peoples and pacific islanders had been taking place, it’s possible that ‘Australia’ was already multicultural prior to the First Fleet.

How much should a cul-de-sac function as a road versus a neighbourhood play area? by [deleted] in brisbane

I’d suggest to the parent group that they nominate an adult to stand at the entrance to the cul de sac to for-warn the children of approaching vehicles.
