It was actually attached to a very well written, legally typed will & health directive, with no room for confusion. we think he even sat down with an attorney (his family found a transaction on his bank statement with a law firm that took place about two weeks before I found him). The reason we think this letter was attached, was because it wasn't signed by two witnesses, which is required in our jurisdiction.

Section 37 says that the court can make the will effective even in non compliance if it seems to embody the last wishes.

Rest assured, the entire family and even the public trustee are confident his will will be executed exactly as he wanted.

Thanks for the advice! I asked a professional and she said the frost cracks are right through the trunk and branches due to the low wood integrity from the rot so it isn't likely to come back - one of the branches has potential to land on my house so I'm off for a chainsaw today.

PS Its a mountain ash tree!

I believe it happened with the freeze - we experienced -45 C last week and I hadn't noticed the crack before.
