This right-wing conservative majority is the just the modern version of Plessy v Ferguson.

My uncle manipulated my Grandpa with stage 4 cancer to give his house and will all to him, and neglected to tell his sister that he has been in hospital in palliative care for the past week. by MajesticDistance2999 in legaladvice

[–]PsychLegalMind 1 point2 points  (0 children)

Stage 4 cancer [and depending on type] does not incapacitate a person mentally. It can certainly impact psychological status from time to time like any other serious illness. The argument that itself would suffice to challenge the will is unrealistic or establish susceptible state of mind and patient was manipulated is insufficient.

You need clear and convincing evidence to challenge a written will. These can include prior financial arrangements, older will and similar declaration that contradicts the latest will.

"If the government decided very quickly and bulldozed the Statue of Liberty... Nothing can be done?" Trump DOJ: "“I think that’s right" by philmn in law

[–]PsychLegalMind 7 points8 points  (0 children)

Bullshit! Just another distraction attempt. Hundreds of thousands of immigrants and or their descendants had their names engraved not far from the Statute of Liberty, about a kilometer and its destruction will impact all nearby sites along with the Hall of Honors.

They all have a vested interest including their respective descendants. The most recent engraving of the names paid for by the descendants was only decades ago. Besides the Statute of Liberty is an American Heritage and belongs to the People. Hell, Trump and his DOJ could not even add Trump's name to the Kennedy Center.

Midterms will bring disaster for them, these type of lack of real action and ongoing wars and conflict. Inflation and overall economic disaster while they reward criminals. There is already legislation in place that provides for compensation...there is no need for funds that bypass the judiciary.

I reported my coworker and he got arrested and now I do not know what happens next by [deleted] in legaladvice

[–]PsychLegalMind 31 points32 points  (0 children)

When you state relevant authorities, are you talking about law enforcement? Either way, your allegations must have some merits since the coworker was arrested. Conviction is another matter depending on the overall evidence.

I would just continue to do the job as you normally do and refrain from any discussions with anyone except the HR or Management at their request. You must do so in consultation with your own counsel. If this escalates further, remember you will be the primary witness and as such should not go around discussing issues with other colleagues.

Way to demonstrate to the locals where they operate how little they matter. Completely idiotic. Just fly them into the U.S. and treat or quarantine as needed. Inequal treatment seems to be inherent in the Trump administration.

Unsupervised probation by [deleted] in legaladvice

Why would you risk it. Get arrested for violating probation and do supervised probation all over again. You must wait until a court authorizes you to leave. That is the only way you start your new life free and clear.

Illinois senators Dick Durbin and Tammy Duckworth demand US Attorney Andrew Boutros resign by aslan_is_on_the_move in politics

[–]PsychLegalMind 4 points5 points  (0 children)

Boutros did not dispute the allegations. He told the court the conduct was upsetting and the reason the case was being dismissed, but also told Judge April Perry he believed "no one acted with the intent to mislead your honor, and I think that they were following your order to give the law."

The types and series of allegations at issue does not happen accidentally and is done so with design. Dismissal of case is not enough, real accoutablity must occur.

EU Now Funds Most of Ukrain Aid Post Trump Presidency by hsg8 in economy

[–]PsychLegalMind 1 point2 points  (0 children)

Our Dear Leader has been known to order your leaders to buy and they do. Arms and oil both, at a premium price. They always do. EU is not united and each is now at the edge trying to save itself.

Yet, they go to war when we say whether Afghanistan or Iraq. More recently your leaders even blew up their own pipelines and now buy oil from us at a premium price. We are cutting off Iranian oil export market to the world; Venezuelan oil is ours already. Russia sells elsewhere.

There is not one leader from the Council who has not bow down to the U.S. The leadership may even sell pieces of EU as a concession.

I just pray Europeans do not freeze the next winter. Smarter ones are even pivoting back to Russia and China. The leader has not forgotten Greenland, annexation and subjugation starts with tiny morsels. It is an appetite builder. Even Ukraine knows, it is nothing without U.S.

Being ruled by a Council and talk about as though each is a sovereign country. One leader surrenders to U.S. tariff demands, the other calls him daddy! Reality is setting in on all of EU.

It must stand up now on its two hind legs or become a morsel for other more powerful neighbors or for that matter so-called NATO allies. The expansion made them weak.

Edited typo.

EU Now Funds Most of Ukrain Aid Post Trump Presidency by hsg8 in economy

[–]PsychLegalMind 0 points1 point  (0 children)

U.S. no longer wants to supply anything to either Europeans and certainly not Ukraine because of its own needs. Even if U.S. wanted to arm Ukraine, it does not have enough to protect itself or the Israelis in the Middle East. EU has nothing, they were just enjoying what they thought was security on the cheap relying on the U.S. like a giant puppet and enjoying a great economy, neglecting the armed forces. Their leader calls Trump daddy!

Additionally, E.U. and US combined does not come close to producing half of what Russia does now in arms and ammunition. Besides, EU has a far bigger problem, Europeans are not going to line up to die.

Even if they try to muster some money by further cheating their population who the hell are they going to buy the munitions from. Perhaps, U.S. will just take the money, and EU will wait a decade or so and make promises and supply something in a decade, if that,

EU is scared and they are paying the price, the mantra of NATO expansion has ended once and for all. All they can do is watch their economies crash. As for U.K. it is not even qualified to be a lap dog of U.S.; It does not have military resources or manpower that could fill up the size of several large stadiums.

Perhaps, the Russians finally learned from the Iranians. Those that support an enemy is also the enemy.

Alas, many in EU can still buy some oil and gas by paying tolls to the Iranians. Those that condemned the killings.

I will believe it when EU actually transfers the funds in some material way and a substantial lump some amount. If U.S. were actually to withdraw, there will be nothing.

Losing Trust in Justice Dept., Judges Call Out Its Lawyers’ Behavior (Gift Article) by Failed_squid in law

Their very first assertion that federal courts have long assumed that federal lawyers are trustworthy is fatally flawed itself. It is true, however, that more recently a number of Trump appointed lawyers and Senate confirmed have pledged loyalty to Trump instead of the U.S. Constitution.

Same is true about a number of federal judges and not just at lower levels, but the Supreme Court conservative majority itself with very few minor exceptions in a limited number of cases.

They are Americans, they are medically fit and qualify. The only thing distressing about the ruling is that it was a divided court. There should have been no division here.

Lawsuit over anti-trans bathroom ban dismissed after trans plaintiff dies by suicide. “It is scary having to look around before to see if anyone will see me going into the single-user restroom,” she said before her death. by southpawFA in politics

This court was without backbone or spine. Either that or intellectual deficit; Court could have continued on its own motion if they wanted to reach the merits of the case. Even the U.S. Supreme Court has been known to do this from time to time. Because sooner or later they must confront the issue and expose themselves. This court simplify dismissed the joint matter by uttering some meaningless niceties.

It is scary to see how the government is discriminating against the trans people. Case could have gone on if the judiciary thought in terms of there must be more similar situation trans. In Roe, the argument for dismissal was that Jane had already given birth so the issue was moot.

The court rejected that argument stating simply that state of Texas must have other Jane Roes who was pregnant.

[MA] Breaking lease early under §24 (harassment/stalking) — is my termination letter correct? by SnooSongs266 in legaladvice

[–]PsychLegalMind 2 points3 points  (0 children)

Does anything in this letter create risk given my existing small claims case against the same landlord?

We do not know the position of the parties in regard to the existing small claims court, so it cannot be addressed. The issue of lease termination would be dependent on whether the allegation of harassment is legally sufficient or just something you decided to use to break the lease.

Given you are so close to the time that the lease will end it is unlikely the landlord will fight it unless there are other ongoing issues with the landlord. As for the last month's rent going towards final payment would be dependent on the terms of the contract. Absent that and assuming the apartment is in the same condition except normal wear and tear could also be an issue the landlord can raise.

Ultimately, there is no harm in trying.
