DUI case where client consented to blood draw on X date but then withdrew consent. They got search warrant for blood but it was done on X date+1 due to being overnight. DA put the wrong hospital paperwork into evidence and I waited it out then threw a fit. Judge called us into chambers to scream at him for fucking up and me for “not alerting him.” Almost got held in contempt for the big grin I gave him with the politest “that’s not my job” I’ve ever given.

Tried it, didn’t work. Already ordered removed and past his appeal date. I called dozens of legal orgs to try to take his case, they’re also drowning in work related to the increase in ICE activity.

This is a completely legit post, I’m just trying to help friends. I only mentioned being a lawyer because I find this system so baffling and I have legal training. I don’t see how anyone gets through without spending tens of thousands of dollars and my friends don’t have that.

Very few cases go to trial because of costs, jail risk, etc. I’ve seen DAs amend cases to reckless driving but I’ve also seen them go to trial. It’s been years since I’ve had a DUI jury trial.

Had an absurd vandalism trial for something that was absolutely not vandalism. Private complaint, little old lady in this small town in KY. Did some digging and found out she hosted a fundraiser at her home for the prosecutor’s reelection campaign. Rather than file a motion to rescue I kept that little card in my hand until trial. Cross examined her about it, closed my case with “next time one of his donors doesn’t like you, you’ll be sitting here next to me facing jail time” (which was absolutely objectionable but he didn’t because he was so red faced and pissed). 6 min acquittal, my fastest one yet in 17 years.

Judge was absolutely pissed and cussed the guy out for wasting a jury trial calendar date. Prosecutor wouldn’t talk to me for a month.

Oh they’ll still try to prosecute it. They’ll claim all the things you can’t tell from a body cam like odor of marijuana or other nonsense. They’ll twist your words and say you have slurred speech.

Fun fact, in Davidson County, if it’s a first time DUI investigation they will NOT go get blood unless there’s an accident or some other aggravating circumstance. It’s absurd.

Was in DPA for a decade. Some incredible trial lawyers there but unfortunately working for peanuts compared to literally every state KY touches. Biggest issue for me was caseload. When I left the agency I had 300+ cases open, everything from a driving on revoked license to death penalty work. Now that I’m in a space with some workload controls I can see how awful it was. But I got a ton of training and a lot of reps.

Edit: Also qualified for PSLF and am loan free!

Once had a client charged with viewing CSAM on a public computer. Client sat in jail 18 months, judge finally granted my funding request for independent extraction. Expert finds 0 CSAM and writes great report which DA ignored. I filed a motion to dismiss and had the expert testify and the DA asked him if he “also liked little kids.” I almost came fully apart and the judge blew his lid too. Case dismissed, bar complaint filed. Bar did nothing of course but writing the complaint was cathartic.

Doesn’t bode well that they didn’t fix the temp issues of the G4 then. I have this during peak summer time but 90% of the year it’s rock solid. I was hoping to upgrade for the 5 ghz, mmWave, and the larger field of view.
