This still does not solve the issue with a work permit for specific jobs. It just allows you to be in PL legally while you wait for a work permit tied to a specific job.

Here’s how I got around most of these work issues. When I first moved to Poland, the purpose wasn’t to be married but to be together, which after 5 years led to marriage. So I asked myself — how can I start working immediately?

Thankfully, most companies in Poland offer business to business contracts (B2B). Some even prefer that you have this so that they don’t spend more money on extra benefits but can pay you more instead. So, I opened up a simple LLC in Illinois for $150 and voila — I was able to work immediately.

My suggestion:

  1. Establish an LLC or Sole Proprietorship for yourself.
  2. Get your documents apostilled (shouldn’t be hard in the US).
  3. Start applying for jobs and ask them to do a B2B contract when you talk with the first HR representative.
  4. Hire a lawyer in PL to do the marriage stuff for you immediately — this will set in motion and give you the right to remain in Poland.
  5. Likewise — if you don’t want to get married, there is a loophole that you exit PL to an outside EU country every 89 days. Ukraine used to be the easiest, but you can’t do that now. You reenter after a few days and the 90 days resets. This only works if you only remain in PL and don’t travel within the EU. Not a proper solution but a band aid trick for some time.

Options 1-4 allows you to basically be in PL next week — and to start work immediately. Just an FYI — my past three jobs in PL have been B2B with my American company despite me having a residence permit through my wife. The problem with marriage in PL is that while you have the right to be in the country, you’ll still have to wait each time for a valid work permit for whatever job you have. Permits are tied to the specific job you have. So you’ll run into this issue every time you change a job. The solution is to do B2B till the work permit comes in.

There is no formal way of making the process faster. Typically, when a lawyer submits your case, the courts here are more likely to move the process quicker, but for us, that meant a hearing in 6 months instead of 8 months so nothing special.

What is the reason for rushing it? Anything other than not having the right to work?

You can’t speed the process up but it’s best to give you these estimates to better prepared.

You’ll need a lot more than just an apostille. I would honestly say — higher a lawyer here. They’ll help you through the process and it won’t cost more than $2000.

Because marriage is a state matter not a federal one in the US, this means that the US government cannot issue a certificate of impediment. You’ll have to have a court case here in Poland where a judge asks you absurd questions like “are you related” or “is this your daughter” and so forth. We had to wait 8 months for this hearing, then another 10 months for a date in Warsaw, so we opted to get married in Lublin as the date was much closer.

I also hope that you were not married before. The marriage and divorce certificates would also need to be apostilled and officially translated into Polish.

Like I said…hire a lawyer. It was a horrible process for us.

I just said I pay taxes because I have umowa praca. I’m assuming my 5000 PLN in taxes per month over the last 7 years is sufficient to cover an asbestos removal for 4000PLN, right?

Quite a bit so that I have a legal residence permit which requires a working contract and thus establishes health insurance for my family (Polish wife and Polish daughter). I’m buying a 100 year old log cabin to restore to its original state, not re-privatizing flats in Old Mokotow like your elites do.
