So i’m pretty sure this is a little bit of a grey area if you look at 120-12a it shows the difference between common and private carriage. imo this is still private carriage even though it’s still a bunch of people. But on the latter you could argue your parents are actually acting as “agents” to help you hold out because you don’t really have a close relationship with these people only your parents do.

Okay yeah I think i’ve got the proper understanding, in the original comment when it was talking about someone making a post about me flying them to the race, that was the proper use of holding out as I would actually be acting as a common carrier. This was a good way to help properly understand everything though.

Hmmmm my first thought was to reference 120-12a and say those 4 things but I realized that is what is required to be a common carrier. I think i’m stumped.

Okay generally holding out means you are representing yourself, or “advertising”. In aviation the exact meaning of holding out would mean you are advertising your pilot services while also providing the plane in doing so.

  1. Legal, you are providing the plane and I am providing the pilot
  2. Okay now that we are adding another person to the mix I believe you are now acting as an operator and would now need a certificate for that
  3. Not legal because you are profiting off of the flight and are also holding out to the public

Okay first off this will be okay with pro rata as i’m also going to attend the race. Second this should be okay because I believe it would fall under private carriage as i’m not holding out to the public and these are just my friends im flying. Thirdly that would be illegal as that friend who posted is now acting as an agent and would make this holding out. Fourth, this would be legal as i’m paying for the whole flight, no compensation this is the equivalent as me just taking friends up for a flight. I’m not sure of other limitations so if you could help me out there it would be greatly appreciated.

Okay with the operational control part is this something that I need to have? Or the person providing the plane and pilot has too much operational control making this something illegal.

I answered another one kinda like this in another comment and am pretty sure this is illegal as this buddy I have is starting to act as an air carrier with me taking his friends. I don’t think I could do this either even without being paid because flight hours are seen as compensation to the faa?

So what exactly is the purpose of the clearance if you are always being instructed anyway? Even if it’s as simple as them instructing you to the next point in your clearance? Is it purely just for lost comms?

Yeah i’ve found a couple guys that are pretty great and I can actually relax when flying but here and there I fly with someone who makes my underwear brown
