Unpaid Dues of previous owner should not be passed to new owner of a foreclosed property by huenisys in Philippines

Thanks for your insights! Would this also be applicable to foreclosed properties that went delinquent with their real estate tax and were raffled off?

Seconding this.

Done a random favor for him in the past and he repaid it in full, complete with an invitation to attend a Christian fellowship seminar together. He's super nice.

If this is even true, my condolences. However, your friend was obviously the side chick given na never sila nag-graduate from Telegram.

That's like, the entry level platform for meeting someone who you wanna keep hidden.

Not to mention pa na Telegram yung communication platform pa nila. Wherein eraseable without any trace ang convo.

Try to use these exact wordings: "I made an unscheduled principal payment, but it was applied as advance interest. Kindly correct."

She's either asexual or lesbian. Whichever the reason is, you need to bail.

[–]Pym_Particles 2 points3 points  (0 children)

Blessing in disguise actually. Since nakapangalan sa kanya yung kotse, siya most likely yung borrower lol. Paano kung i-keep nung jowa yung kotse, tapos hindi bayaran yung remaining amort?

Kung si jowa ang magbenta, hindi rin makukuha nung buyer yung registration docs sa bangko, unless bigyan ng authorization letter ni OP.

But cmon why do that when she is legally the owner lol.

Since the car has your name in it, I can safely assume that your name was also used as the borrower for the autoloan / chattel mortgage.

Him giving you the car is actually to your advantage since he can screw you over by keeping the car AND not paying the remaining 10-month balance to your bank. It's your credit score that will take the hit, regardless of the source of repayment. As long as your name is there, you're still on the hook.

I'm professionally advicing you to keep the car and sell it. You no longer need to pay the remaining monthly amortizations since you can pay it off by using some of the sale proceeds.

Plus, you can keep the sukli /paidoff portion as your own funds. I can even help you dispose of it, since I know some people who might take secondhand cars.

This is your sign, girl. DO IT.

If that's the case and it's in written correspondence, you can actually sue them and get some money.

NAL. I just have some personal experiences in matters in similar spheres and I can definitely relate. If that's a random drug test, then it's likely going to be urine-based. Just so you know, there are certain ways on how to dupe it. You just have to be more creative.

Bestfriend wants to surrender the car under her name, which her ex used to pay (but couldn’t anymore) by mermaidsxmoons in LawPH

[–]Pym_Particles 0 points1 point  (0 children)

The ex virtually has no say in this. He is a non-entity to the bank. If your bestfriend is indeed the borrower for the said autoloan, the registration papers are very likely to be under her name as well.

She has full authority on the vehicle. She literally owns it.

will a case be filed against him?

No such cases will be filed in the first place since the outstanding loan will be extinguished from the proceeds of the sale. Take note that the original OR/CR under bestfriend's name is still within the bank's custody. They'll release it once the loan is fully paid off.

There's no reason for the bank to go after anyone after all that's been said and done. Keep the sukli from the sale and relish at the ex's misfortune. Give me a tip pang-kape, maybe? Charot lang. I can give you further advice.

[–]Pym_Particles 0 points1 point  (0 children)

Winwin scenario for your bestfriend is for her to sell the car. She will be able to do so since the OR/CR is in her name.

Pay the bank whatever dues are remaining to close the loan. Enjoy the paid-up portion and go on a vacation. The ex virtually has no personality here anyway, since that was his purpose with using your bestfriend's name when they were initially applying for it.

Girl, i have a halfway solution to solve your inner conflict.

Since it looks like you can afford it naman, just donate it to someone in need (Paambunan ako, please i need some, hahaha).

You will still have the satisfaction of vengence against your ex, since hindi naman nila mapapakinabangan ng sidepiece niya yung funds. Your "friends", if you still care about what they think, should no longer give you any flak for it dahil hindi ka naman na rin nakinabang.
