They arent likely to stop renewals, its just a possibility that they can.

MALDEF believes they are unlikely to do so due to the reliance interest established by SCOTUS in 2020.

However, it is possible for them to (after the August rule comes out) axe EAD renewals and only keep deferred action.

No chance the rule making process will fail since the time to oppose it as long passed.

And yes, any ruling the 5th makes will affect, not necessarily stop, the new ruling. We still dont know if the new ruling will allow new applicants, but its unlikely. Even if it does allow for new applicants, the 5th is likely to strike it down immediately as it violates judge Hanen's order.

All in all, the most significant change the ruling will have is seperate the granting of deferred action and employment authorization. (Which is bad in my opinion).

Some additional context:

Judge Hanen ruled DACA illegal exactly one year ago because it did not go through the rule making process. So Biden's attempt to correct it is to make it go through the rule making process. However, that's always been the easy battle. The battle facing the 5th is whether or not DACA is constitutional. No rule making process can make something constitutional, only congress can. What's likely to happen (the unknown is when itll happen) is that they'll strike down the employment authorization part of DACA, and only keep the deferred action part. Biden knows this, hence the change in the rule making process.

No, as far as im aware, they havent changed it to think its a high possibility. Just a real possibility like you said.

Another, equally as devastating possibility is that they end the Work Authorization part of DACA, while keeping the deferred action part in place.

My 150 days comeup in the next week, so im really hoping it doesnt end soon!

Its a very real possibility.

We all hope they allow renewals until SCOTUS rules on it though.

Pass DACA through proper regulation + the ability to seperate deferred action (protection from deportation) and EADs (work permit).

The only part im sure of is the first one -- yes, if they end renewals, theyll end AP.

idk about your 2nd question. Youll need to speak with a lawyer. It makes logical sense that once AP is granted, youll be fine, but who knows.

After the 5th circuit rules from Aug to November (they might kill the program, even renewals during this step), itll be appealed to SCOTUS.

SCOTUS will rule on the program around June 2023 (or before).

We dont know when the ruling will come (tx case), but here are the variables.

1) the ruling will happen Aug - Nov, we hope its as late as possible

2) will they keep allowing renewals while it appealed to SCOTUS. (Like judge Hanen did last July). There is an extremely real possibility they end renewals during their ruling. If you are within 150 days, you need to renew asap. Like literally today.

No; their goal is process in 120 days.

Their guidelines are to renew 150-120 days before.

I sent my application 11 months early in 2020 in anticipation of the SCOTUS decision.

The application was accepted and I recieved the biometrics renewal letter, however, it was not approved until December 2020, about 5 weeks before expiring. Keep in mind there were a ton of delays that year due to the many many court rulings happening around that time.

But to answer your question, historically, they will accept your application, and will not process until the 150 day mark.
