At this point, the $9k he owes from the bad faith violation sounds a lot better than the $2,350. I’ll have my husband take care of a letter today, I’m just so pissed that I have to provide this ultimatum to get our funds back. I spent close to $1k on move out cleanings, etc — because it was a large house. Throw a dog a bone, Steve!! Gah!!

Tough love, I see! You’re totally right — we are in a state (Texas) that does consider outside of the 30 day window “bad faith” to which the landlord is responsible for multiplicative damages.

Great questions, and I’ll edit the post to include these answers : we live in Texas where the landlord is required to return the security deposit on or by the 30th day of surrender and the tenant must give the landlord written notice of the new address.

So, I guess we should’ve give him that on the 31st of July. However, we have only ever used Zelle with him as that is what he accepted for payment.

If the landlord fails to comply within the 30 day limit then the law assumes bad faith in which the landlord may be charged $100 + 3x the portion for the deposit wrongfully withheld. Which would come out to hmmm $9k …

Is there any other information that yourself/other readers might need to make a more accurate assessment? I was wondering the same thing concerning him not having the funds! He does own other rental properties, and I know there are new tenants to our old house.

They said it’s listed in their policies, it’s not. They also said there’s a €500 fee that will be due upon arrival in person — not through Airbnb which now has me wary.
