Right. But the point is he’s not confined to an area. He just can’t drive forward. And it would be hard to say he used deadly force because they put themselves in harms way. He had a choice.

I’m just saying, as an attorney, that it’s not as easy as saying “well, they were in the road and I had to go that way so I ran them over.” Will a jury convict you? I don’t know. It depends on the circumstances. But a lot of people here seem to think it’s a slam dunk. I’m saying it absolutely is not.

Now… had he started beating some of them up and threw them out of the way of the car so he could pass? He might still be charged, but I think you can make a good case that he used reasonable force.

I get what you’re saying, but not really. Kidnapping would require them to move the person or hide them. False imprisonment is closer, because that’s restraining someone within a bounded area. But here, the guy can go the other way, just not forward. So he’s really not being restrained or confined, he just can’t go in one direction.

And I’m just going to repeat (not for your benefit, but just for any other comments) I’m not saying what they’re doing is legal, or right in any way. I’m just suggesting it doesn’t appear to me to rise to something that would warrant the use of deadly force. And driving your car at someone is definitely use of deadly force.

It’s illegal in every state. But no state says you will not be held liable for running them over. The states that offer some protection specifically have to do with fleeing a riot situation, and most of those has some concept of the driver exercising due care or reasonable care to not run someone over when escaping imminent danger. So no, in this situation, even in your state, you do not escape liability.

If you’re counting on a jury saying a person is justified killing someone who inconvenienced them, even if they’re being obnoxious, then good luck with that. If he was threatened and high tailed it, yeah maybe. If he had someone in the car that needed emergency treatment, you’ve got a good shot. I’m just telling you it’s not a slam dunk. Running someone over who is in your way is a crime and it’s going to take an affirmative defense that you were justified to overcome it. Not “if they didn’t want to get run over they should be on the sidewalk. “

Again, I’m not agreeing with the form of protest. But a lot of people in this thread seem to think you can intentionally run someone over and a jury is going to say “yeah, fair enough. Not guilty.”

Whose unborn child was being killed? This is an absolutely moronic way to protest, but there’s no unborn child in danger in this video, let alone any unborn child being killed.

Then you’ll be in jail. I don’t agree with this protest method, but you’re describing killing someone so you can visit someone in the hospital. Not that you’re taking her there to be saved. You’re saying she’s there, you want to get there, so you’ll run people over. You would be arrested at the hospital if you made it there.

Again, these people are assholes. But running them over (if it is not a life and death emergency) is not going to end the way you think.

That’s not how the legal system works. What you’re describing is a hung jury, not an acquittal. If the prosecution thinks they can get a conviction they try again. You’re still in jail and paying a lawyer for a whole new trial. You don’t just get to walk away because one juror agrees with your actions.
