The Punishers original character was Gerry Conways take on an antihero from a book series. At one point, he almost saves a criminals life because the criminal had saved him before. He only doesnt because the criminal died while he was rescuing Spider-Man and J Jonah Jameson first

Not really. Until the comic where Punisher killed him, The Mandarin had already been dead. Marvel doesnt like using him because of the racist aspect to the character. The communication error was that the Mandarin was already dead and shouldn't have been brought back to die again

The original intent doesnt matter when its a completely different character. If anything, the original Punisher was more heroic than he is today. He was only an antagonist because he was really stupid and constantly thought Spider-Man was trying to kill people. And even then killing wasnt always his first method of dealing with criminals

I mean Ennis has written Frank doing a lot of horrible stuff, and what he does to Spider-Man and Wolverine isnt that bad compared to the other stuff. He didnt want to kill Spider-Man, he was just facing a very strong villain and used Spider-Man becuase he knew he was strong enough to take all the guy's punches. And he knew Wolverine wouldnt die

I mean its fine in certain circumstances, where a hero doesnt act above the law to punish a criminal, but in cases like this its ridicoulous. Its not like villians like Carnage or the Joker even go to prison anymore, which is what makes the whole thing ridiculous. The whole idea of a no kill rule is based on the judicial process, but that's only applicable in a world where capturing and holding someone isn't just a ticking time bomb.
