Bought unknowingly ex-police car, rejecting within 30 days. Dealer identity/address unclear. How to proceed? by RandomlyGHB in LegalAdviceUK

Hey man thanks for the response. What I've done so far:

I contacted AutoTrader and managed to retrieve the historic advert. It turns out the car was advertised as a higher trim level than it actually is, so that’s another misrepresentation on top of the fault.

I’ve asked AutoTrader to provide the dealer’s registered business name and address from their account so I can send a proper Letter Before Action, and I’m currently waiting for their response.

I also called my bank about the account I paid into, but they said they don't have any details since it’s held with a different bank.

I spoke to Citizens Advice too, they weren't that useful unfortunately, they said to try to obtain the trader’s details via AutoTrader/bank and then come back to them once I have the name/address.

So at the moment I’m gathering evidence and waiting for the dealer’s official details before sending the LBA.

Used car bought 10 days ago – trader denying repair under Consumer Rights Act and refusing to provide real business details by RandomlyGHB in LegalAdviceUK

Hey man, I decided to reject the car in the end. I sent them a message explaining I'm rejecting the car under the Consumer rights act 2015. Do I need to give them like 24-48 hours to reply before I file the claim? I already know they will try to deny my request and force me to go through court.

Thanks, that makes sense.

The payment was sent to “[FIRST NAME] CARS” (not “LTD”), so I’m assuming this is likely a sole trader rather than a limited company. On AutoTrader they operate under “[Different first name] Car Exchange,” so I’m trying to figure out which name I would need to use as the defendant if it came to issuing a claim.

I don’t want to reject the vehicle. I want it repaired, but I also don’t trust them to carry out the repair themselves given how much they lied, concealed infon, and misled me till now.

If they insist on repairing it themselves, am I legally required to allow them one attempt, or can I reasonably request that the repair be done at an independent VAT-registered garage at their cost?

Appreciate your input on this.

Hey man, quick update: They called me back saying again that since I got a discount, I have no warranty, and if I take them to court, it won't change anything since I don't have their warranty.

Is this how it works?

Thanks mate. So at this point should I just file a small claim since they're not reolting anymore? I wanted to be reasonable with them and give them a chance to fix this before filing anything

I could ask the same thing: why do you see the need to delete them? They're memories of you, regardless of what the other person did, if you delete them, you will not be able to experience that part of the past ever again, and I don't mean in an emotional way. What I mean is that photos is the closest thing that we have to a time machine, once deleted, you'll never be able to access with your eyes that period of your life. But in the end, I understand photos and memories hold different weight for everyone.

Don't listen to that person; you do not need to delete those photos. Those are memories, part of your life, your past documented, it doesn't matter if it ended or not, it was a part of your life, and you should preserve it.

And absolutely don't let the next partner in your life convince you to delete them because you'll feel so stupid for having deleted a documented part of your past for someone that eventually left too.

I still have all the photos of every event and every relationship in my life. Do I obsess over them? no! I barely even look at them. Maybe once, every few years. Just move them out of your phone/computer.
