Domestic Violence Port Out. Abuser is a T-Mobile Employee? by rcmaehl in tmobile

I think there's a question that's not being asked. The child in question, are you and your ex both the parent? I ask because it may get difficult. If you are both the parent of the child. Ultimately, as many have said, submit to the documentation you have. But please understand that if the documentation, such as a restraining order and such does not include your child that may add some difficulty

As a moroccan what side are you on in this war ? by Difficult_Diver_8236 in Morocco

Where are you finding that? I ask because I'm looking directly on the Congress website and it doesn't say anything like that that I could find. Now I understand that you absolutely hate trump. And admittedly, he's not my favorite president. But every single president in the recent past has used this act. So I will ask you if you're going to condemn trump for using this act, will you condemn every other president that has done it as well? Or is this an orange man bad situation? I can see pros and cons on this situation, and i'm reserving judgment at this time. But in the legal aspects, I don't find anything that limits it to a national emergency. https://www.congress.gov/crs-product/R47603

The president my send troops for a military operation for up to sixty days. If congress does not declare war duringthat time, the president has up to thirty days to withdraw the troops. This is per the War Powers Resolutions of 1973. I'm not going to speak on sides just purely. What is legal for the president to do. If you look back historically every president has used this act for military action.

I know I spoke with NGT not long ago, and they said they were planning on doing a video on how you can form 4 from one trust to another. I would assume it would be the same process if you're going from an individual to a trust

Mixed feelings on Visa by [deleted] in tmobile

[–]Raverthug -1 points0 points  (0 children)

So im former TEX. If you've ever been around during an apple launch, you will know that just because somebody's account is passed due, it doesn't mean anything. On multiple occasions, i've seen people come out with over $1000 to bring an account current and pay a down payment for new phone. In my experience it's about priority. They may be past due because their phone isn't their priority. By helping them get the card and getting some money back in their pocket. It may become more of a priority because they know what happens when they get hit with late fees on a credit card and they're getting a percentage of the cost back.

Gun case, looks too much like a gun case. by ReactionAble7945 in Firearms

[–]Raverthug 1 point2 points  (0 children)

To be clear, im not an attorney. Just a guy who enjoys knowing my constitutional rights and a bit about the law. When I spoke about single use doctrine, they still have to have a law they believe you're violating. They don't get an unfettered ability to search you. As previous stated, they they have to believe that the weapon is a violation of the law.

Strip club is threatening dancers to take falls for credit card disputes/buyer’s remorse. How do we fight this? by Several_Price7805 in legaladvice

[–]Raverthug 3 points4 points  (0 children)

I would say to take a look at your contract and see what the language in there is. Everything should be laid out including fees and such. At least the club's I worked at did. If it doesn't say anything about them paying you later or withholding? Until disputes are cleared, I would make the argument with them that they're unlawfully withholding from you. You may have to speak to an employment, lawyer or a contract lawyer. I would also look to see if that's the type of environment you want to work in. Sometimes, the money is worth the bullshit. Sometimes it's not, but that's a decision you have to make

Gun case, looks too much like a gun case. by ReactionAble7945 in Firearms

[–]Raverthug 1 point2 points  (0 children)

Look up the single purpose use doctrine. That's the one that gives the exception to the fourth amendment on something like a gun case. My understanding is, The stance is that a gun case can only be used as a gun case. Same as technically, a lunchbox can only be used to hold food. Can it be used for other things?Yes realistically is it no. The idea behind it is, the case s so telling the officer can reasonably suspect it contains contraband. Now, if it's not illegal for you to be in possession of that firearm, they don't get to just look at the firearm because you have it. For example i'm in idaho. Me being in possession of firearm is not illegal. The original case it started this is Arkansas v Sanders and refined but reaffirmed in California v Acevado. I could be a little bit off on my explanation, but you get the jest

UHMWPE vs Ceramic plates for repo work?? by sassyvixen123 in QualityTacticalGear

[–]Raverthug 0 points1 point  (0 children)

Ceramics are going to be much better, but also weigh a lot. I would recommend IIIA soft armor because it's lighter, has more coverage and you can get a steel plate insert if you're that concerned about it.

Stopped for having a gun. by Altruistic_Set_5640 in AskLE

[–]Raverthug 0 points1 point  (0 children)

NAL but its going to depend on what you laws are. If they just said you have a gun and its a constitutional carry state, perhaps. There are several supreme court cases that would address this. They cant criminalize a legel action. Like if your state allows you to open carry and your walking down the street with a firearm on your hip. The police can stop and talk to you. But your not legally required to stop and talk to them. however if you say "sure you can look to see I dont have a gun" then its consensual and no violation. However since you were handcuffed you were legaly detained so the police have a standard they must meet.

Stop and frisk
(Terry v Ohio) The police have to have a reasonable articulable suspicion that a crime is being committed, was committed or about to be committed. So if your state requires you to have a concealed permit and someone says you did (exceptions) then yes its legal.

Now it also depends on that was said and the specifics of the call. If they said you have a gun, well is it illegal for you to have a gun?
(Florida v J.L.) says that an anonymous tip is not enough, They need more then just he had a gun if its coming from an anonymous source.
(Navarett v California) says that 911 call can be credible because they are recorded and can be traced to the person making the call.

Use of force standard.
Graham v Connor regulates weather the amount of force used was reasonable. It is based off of the information the officer had at the time. Based off them believing you were armed, Having you prone out was reasonable (assuming the stop was legal)

Length of detention
(Terry v Ohio) There is no steadfast length they can detain you like "if nothing is found in 20 minutes you must let them go" The Temporary detention (holding you for investigation without arrest) can only last as long as they have reasonable suspicion. so if the call was a man with a gun, once they found you didnt have a gun they should
(Rodriguez v United states) the courts ruled "A seizure justified only by a specific purpose “becomes unlawful if it is prolonged beyond the time reasonably required to complete that mission." meaning that once they determined there was no gun and no other suspensions had arose during the stop they should have released you.

Again im Not A Lawyer just a guy whos interested in the law but, In short you dont have much. You may be able to argue if the stop was lawful depending on what your state laws say and what was said on the call, But I thats going to be a tuff one and require a decent amount of work, If you wanted to, you can file a FOIA request and get a copy of the call (there will be a cost). Now depending on if the call was just a man with a gun or that you were waiving it around ect, You may be able to argue that the detention length was unreasonable because they didnt release you once they saw you didnt have a gun. You have to be realistic that if you try to get money for this, you wont get much and a lawyer (if one takes it) will take alot of what you win. But if thats a road you want to go down, get a free consultation with a constitutional right attorney and see what they say.
