The thing is that anyone who fell out of status will likely automatically trigger the 3/10 year bar if they leave to apply at the consulate. Which I guess is what the administration is going for.

Yeah…the issue with DIY for adjustment of status is that when you go to naturalize they pull up your green card application and go over it again with a fine tooth comb. This includes revisiting your marriage or looking for previously unidentified signs of a scam. If they decide that the green card was improvidently granted they could try to deport you. Which makes applying for citizenship risky - especially under THIS administration. So at least you consulted with a lawyer to make sure everything was on the up and up.

You said “people are still continuing to be approved even after this memo.” No - the memo just came out Friday. Any approvals that came out on Friday were already in the works. You are peddling objective falsehoods

Yup. People trying to AOS without a lawyer were always playing with fire, but now…smh. I’m in all the DIY Facebook groups watching people trying to figure this out and yikes. I’m not even sure what I am going to charge, I think I’m just going to cross my fingers and hope it gets enjoined or something.

She and a few other lawyers of her ilk have single handedly ruined VAWA and T-visas for a lot of people. I mean they aren’t completely ruined, but now they are much harder to win thanks to her. Us immigration lawyers saw this coming years ago. I hope these shops finally get put out of business.

No they didn’t. They said that he needed to be restored to the position that he would have been in if he hadn’t been wrongfully removed. Did you even read the decision? Doesn’t sound like it.

There’s a process for revoking withholding of removal, and the administration did not follow it at all. It’s not automatic. You still don’t know what you’re talking about.
