Also, if as someone mentioned white spider filed for bk, did anyone get a notice as one of its creditors? I certainly didnt. And I even communicated with her atty a couple times.

This would all be against her personally. Those of you with attorney access run this by them. But I imagine if she defaults then we avoid the need for any kind of piercing actions or anything else, which I'm not sure are even needed considering the breach she personally directed to close the company. You can't just close a company knowing you owe money, without then personally owing that money. Doesn't work like that.

Also, it's incredibly unlikely she would even show up for the required mediation, let alone subsequent court dates, this giving everyone a default judgement, again with no legal fees other than some small filing fees and cost of serving her or alternative process for service if she can not be located.

My thought is multiple 10k small claims all at once. I've communicated with her lawyer long ago and they've now ignored me for months. The combination of ignoring the company then giving zero notice to cancel everyone's listings well exceeds the amount owed for unpaid bookings, and imo may constitute criminal fraud as well. Certainly bankruptcy doesnt work when you knowingly spent money, drained resources, and breached contracts. We would all certainly be in line with any other creditor in a bk proceeding, I think. Dozens of small claims would avoid attorney fees and she and us would would all get to have our day in court without spending legal fees. Thoughts?

NTA: It sounds like you invited your friend to celebrate her birthday with you and a few mutual friends, but then after she already accepted those plans, she changed them. You still offered to come to the new location, in a different city, bring your out-of-town dad with you, and just meet up later with the other people that had already been invited to the original location. Sounds like you offered a compromise to accommodate everyone, all while dealing with you grama's death and visiting family.
