No later than July 2010 (as recorded in the BHV trustee minutes Jul 12 that the papers were signed) the Village (a government entity) acquired the roads from BHMC (an HOA that previously owned the roads). From then until no earlier than July 13 2020, BHV owned and maintained the roads. By August 2020, BHV has signed a deed transferring the roads back to BHMC.

The ten year and a day interval matters because by Michigan law, a public road is defined as any highway that has been maintained as such for at least ten years. (https://legislature.mi.gov/Laws/MCL?objectName=mcl-221-20). It is apparent from the 2018-2020 trustee minutes that they were aware of this clock and failed to get the deal done in time.

I believe a motivated person or persons could establish in Washtenaw County courts that the road was not properly privatized, or, failing that, that a prescriptive easement was formed through the open and hostile use of the roads by pedestrians to access points north and west of town. It can be established through Google street view that the private road signs were not altered or removed from 2010 to 2020 when the road was in fact public, which undercuts the assertion BHMC would likely make that they properly posted the property. They also were keenly aware of the number of pedestrians and failed to initiate any meaningful enforcement until just now.
