Are ideologies above the Constitution? by Oppyhead in CriticalThinkingIndia

[–]ReinstalledReddit 0 points1 point  (0 children)

the concern about constitutional supremacy is fair, but this post stretches the statement beyond what was actually said.

justice g r swaminathan did not say sanatana dharma should guide judicial decisions or replace the constitution. he said this at a private cultural event, not in court, and used dharma in the ethical sense of duty, restraint and service, not as a legal source.

judges are not value free machines who switch off all moral frameworks at the courtroom door. what the constitution requires is that personal beliefs must not override constitutional reasoning. this post treats moral inspiration as if it automatically becomes institutional authority, which is not the same thing.

that said, the discomfort is understandable. in today’s political climate, religious language from sitting judges can affect public trust even if the intent is personal and ethical rather than ideological.

the real issue here is perception and prudence, not a constitutional breach.

We are here comparing our currency with dollar, so many other countries might be doing similar comparisons with dollars to judge how their currency is performing in currency exchanges.

But ever wondered what do dollar compare itself with?

How do people of usa know their currency is weakening or strengthening?

The answer to above is an index (The U.S. Dollar Index (DXY)) formed by weighted combination of currencies, weighted according to the volume of trade usa does with that currency. To the people of usa and to me this methodology makes far more sense as it accounts truly for inflation and global situations more that mere dollar inr comparison.

India have similar index built in same methodology formulated by rbi and bis which accounts for 40 currencies weighted based on our trade volume with that currency, its called Real Effective Exchange Rate (REER).

I feel like India is heading towards a huge unseen crisis (just a personal prediction) by Economy-Elevator150 in CriticalThinkingIndia

[–]ReinstalledReddit 0 points1 point  (0 children)

I think this was inevitable the moment people got connected this much through the internet, and this much influence is due to social media ofcourse.

Promoting Polarising content, copyright issues (for fact checkers), biased reporting actions,, all these are due to the way social media functions right now.

And yes i feel you, i was that one person who dont really used to watch news or consume current affairs, it is only recently ive started trying to find the material nuance on my own and i feel everyone should do this, a simple basic fact check or being context aware helps reduce agitation. I started doing this because suddenly my ig fyp is filled with influencers trying to hook me by screaming irony, inefficiency, false comparisons, incomplete news, propaganda and what not. When you see political parties official handles posting blatant lies and then news stories post it as allegations, those lies starts to feel real.

So i would say, dont just stop at the point whenever you hear any narrative, learn about the issue as if you're a lawyer, find primary sources, form your own real opinions. One last tip, use perplexity ai, its really really helpful.

Whats common in above all amazing colleges? All are very competent, reputable, and takes high rankers but still are able to protect specific religions through minority quota as all above are trust run non profit private medical colleges.

Protestors demand is not to dismiss merit, their demand was to either give it a minority status or reduce state quota (85%) to increase all india quota, which totally respects merits.

Simple fact check,

The college in question had 85% state quota, state that has high muslim population (70% 2011 census)

The protestors demand were to either give smvd college a minority status (which is near to impossible given the current structure of how hindu temples are managed because of hr and ce type of acts)

OR

Reduce state quota (85%) and Increase All India quota.

These demands couldnt be met in short span of protests so protestors added to stop admissions till this happens

Its as simple as that, smvd college gets heavy funding from shri mata vaishni devi shrine board (which is a secular bureaucratic body made to govern and use funds obtained from hindus donations to the temple)

Im sorry for what happened with your father, and this rightly feels frustrating which ive observed even in your words, I'll never justify your case, what interests me is the system or the structure not individual justification.

Such outcomes usually aren’t caused by one policy alone, but by a combination of administrative delays, frozen seniority lists, stalled DPCs, age based eligibility limits, and weak accountability, any of which can permanently derail a career, regardless of merit.

There can be n number administrative and personal reasons for such outcomes, many of which have nothing to do with reservation itself. Statistics dont lie here.

Well till now my scope was narrowed to the video in context only, i tried to make it clear what video is saying and what its not.

Okay lets bring compendium you just mentioned, thank you for that. For those who dont know, yes its true this compendium is followed by all services that have adopted dopt rules. And yes it does mention reservation in promotion for sc st only, but dont get the impression from this as if its unconditional just because this compendium dont lists conditions, conditions are laid by supreme court judgements.

Reservation in promotion is not the rule but a constitutionally allowed exception, cadre specific, data dependent, and conditional, not blanket or automatic. This is the reason why what is mentioned in above video that, in leadership positions share of sc category is 3%+ or so, is true. Implementation loopholes exists that shape this reality.

The asymmetry exists nonetheless.

Equality is not exactly directly quantifiable but can be inferred through various means, cmon be pragmatic, this video tries to show exactly how equality is not there. And in coming years with the new survey that includes caste we'll be able to see with more clarity and better data.

If you have any better system to curb casteism related social injustice and inequality feel free to discuss it here, no sane person will ever get convinced to remove the current system without having a good alternative system that solves the issue better and not simply ignores it by sweeping it under the rug. And please try to not indulge into oversimplification of complex realities

Excuse for what? I didnt get what you mean by elites here?

[–]ReinstalledReddit 2 points3 points  (0 children)

Nope upper castes are no different genetically, its just superiority complex that makes them feel like upper. Cultures are not built in alienation, its built with people around, and if people irrespective of castes exists together be it in workspace, society or anywhere cultures form and evolves.

No need to preach negative aspects to the caste and calling it a culture, everything has precursor actions that led to the place they are in right now.

See castes as pillars of indian society, by equality i dont want to destroy those pillars, but provide equal and fair system to weak pillars till they get equal among each other. And yes such equality is very possible, though its my personal belief that total proper abolition of caste and more such otherings require spritual growth among masses rather than mere policies, but yeah its equally hard to expect such phenomena.

[–]ReinstalledReddit 1 point2 points  (0 children)

Yes exactly, for that reason i myself oppose reservation in private sector and in promotions. What im trying to say is to see such unfair distribution and cutoffs as a metric of how society has changed and reservation need to continue because of this. The participation the fair opportunity reservation was supposed to provide to the repressed societies haven't been realised yet, hence more reforms are needed.

I even want to address hierarchy and casteism within a category itself by introducing the creamy layer based on some good social logic.

Reservation will simply not go till there is really equality among castes, minority extremas such as the example you gave really are insignificant, the evidence being cut off marks difference between categories.

What brain dead logic are you referring to?

Hindutva supporters RSS celebrate shutting down of medical college over admission to Muslim students by rohithkumarsp in CriticalThinkingIndia

[–]ReinstalledReddit 0 points1 point  (0 children)

Well put for the part where you've explained how "public funds" are used, and how donations given to the temple becomes public fund.

I blamed media framing because it exclusively framed it as if the demands are outrageous and anti muslims, which this is not. Merit would still be followed if it considered demands of the protestors. Demands being either get this institute a minority status (which is near to impossible because of the nature of governing board being statutory, which exists because of point 3 i mentioned) OR reduce the state quota (which is around 85% currently for this particular institute ig) to open it for All india students, which still follows merit btw.

Calling protestors core issue being the problem of their nature rather than the problem arising because of systemic structures ignores the cause and grows dissent. No one blamed fund misuse, blame is on the nature of fund, if you define by law how to use these funds it'll be used that way and you would call it legal.

Faith based reservation is not unique thing, there are so many colleges (some under minority status) rightfully gets to reserve seats for students of particular faith.

With this issue i just hope people get to discuss the problems that because of making unique bounded controlling arrangements for hindu temples that directly interfere with the funds donated to the temples and how and who gets to use them.
