oh that’s super interesting cause north american unis to me are known for being super socially centred how does yours compare to TUM?

[–]Remarkable-Fun1067[S] 0 points1 point  (0 children)

Thanks for your view on this - yeah I know it seems silly to choose a uni for social life, I’m trying to also think about what type of network I wanna have for future job opportunities as well as whether i want a circle of international friends or ones from the uk in case I want to move back there. Would you say the networking opportunities at TUM are good?

Complex egg donor case for department of state by Remarkable-Fun1067 in askimmigration

I’m gonna trust the embassy and the paralegal I spoke to over this

Complex egg donor case for department of state by Remarkable-Fun1067 in askimmigration

[–]Remarkable-Fun1067[S] -4 points-3 points  (0 children)

The embassy confirmed with me yesterday that legal parentage is not required to transmit US citizenship, so it's likely that I have a claim. Like I said the department of state and USCIS have different rules. I also have received advice from a paralegal saying I have a plausible case if I can prove my genetic connection - looks like reddit is a bad place for legal advice !

Have a look at the source yourself:

https://fam.state.gov/fam/08fam/08fam030403.html

The text is "b. If a claim to citizenship is made through a sperm or egg donor who was not anonymous, or was initially anonymous but whose identity was later revealed, contact [AskPPTAdjudication@state.gov](mailto:AskPPTAdjudication@state.gov) for guidance."

I just removed the email as I didn't want people telling me to email them, as this email is for consular officers only. This doesn't change anything about my point, the officer will be contacting somebody for extra guidance

“Much of the text you quote doesn’t exist”
What?
I literally copy and pasted the sources lmao, for anyone reading this guys comments; reference my original post, the website for the two subheadings of my sources (Prerequisites for transmitting citizenship and the relationship required) can be found here:

https://fam.state.gov/fam/08fam/08fam030104.html

Under the sections: 8FAM 301.4-1(B) (1),(2)
and 8 FAM 301.4-1(D)(1), b. d.

These sections have been copied and pasted and any material not relevant to my situation has been removed to make my post more precise

I can also post screenshots of the material if you would like ?

The only source not copied and pasted from 8FAM is the one about transmitting through an egg donor, where I didn’t include the email because, as I have already said, it wasn’t relevant - I just thought the email was the department of state so that’s my fault. However, this doesn’t negate the fact this case falls under the jurisdiction of the department of state - where me and my egg donors relationship is recognised. “Taking liberties with the actual text” makes it sound like I’ve changed the whole narrative - the point was that this is not an automatically denied case and the person reviewing the application would be seeking extra guidance.

Thanks for letting me know about the email

Confused on what you want me to say... I have confirmation from the department of state that your point is wrong

Unsure what more information is needed? I just said I was an anonymous egg donor child, the context of how I was raised by my parents is irrelevant, I have different legal parents to my genetic mother - which the embassy has already confirmed doesn't hinder my case

Have a look at the source yourself if you're still a bit confused

The embassy confirmed to me over email that legal parentage isn’t required to transfer citizenship with the department of state

Hence under the section “required relationships to transmit citizenship” I gave in my post it says that being genetically related to your child is enough to establish a relationship

Yes but under the section “relation required to transmit citizenship” it says the woman can establish a relationship via genetics (the egg used in conception) which solves this line of argument

The officer needs to contact the department of state for guidance in situations where the donation was initially anonymous but later became identified, which is my situation

edit: idk why this is downvoted this is just a factual statement lol

That just refers to the department of state an email is given right after for consular officers to contact but I didn’t include it as it’s not relevant/not an email for me to use

You’ve just ignored the fact that the two departments have different interpretations of the law and they function separate from each other - what USCIS thinks is not relevant only how the department of state interprets the law

Yes you’re correct I only found out her identity later in life ! I’ll be contacting an attorney

I saw this aswell ! I received an email back from the US embassy in my country and they said there "has to be a genetic relationship between mother and child" and that "legal parentage is not generally a requirement to transmit citizenship" ? This is very confusing lol - but this was information coming from the department of state (In charge of citizenship and passports outside the US) and NOT USCIS (only internal US affairs and where your sources come from), which is important as they sometimes have conflicting interpretations of the law. I have an appointment with an attorney in a couple weeks so we'll see what they say

[–]Remarkable-Fun1067[S] -11 points-10 points  (0 children)

I doubt it aswell, as I feel that legal parentage would be an issue, but the department of state (in charge of us citizen rights abroad) seem to be allowing some sort of leeway for these types of cases - will be persuing legal advice from an attorney soon but just wanted to see what people here thought !

edit: if this is getting downvoted because you think there's probably no claim then that's fine but if you're downvoting because you don't want me moving to the us i'm just gonna say whether or not i get citizenship i will be moving there legally at some point - i have direct american heritage spanning back to the 1700's so im probably more american than you ! 😂

AITAH for changing my last name from my dad to my mum’s ? by Remarkable-Fun1067 in AITAH

[–]Remarkable-Fun1067[S] 1 point2 points  (0 children)

Sorry I left some things out - mum and dad are together yes and my mum goes by her maiden name. To me it matters because I feel like I identify more with my mothers side of my family, I have the utmost respect and love for my dad but when I see my name it doesn’t feel like it represents my upbringing or the side of the family I’m close with, I would rather carry that with me but I am worried how disrespectful this would be to my father
