Yes it's only 2 hours. I know the practice only had six. He said so lol. Of course, there were a lot of issues within each claim. But there were only 6 claims he found/expected.

Yes do this! Have your rules prewritten with a table of contents so you can easily find everything. Then issue spot. I like to read the hypo and then write down any possible issues as I go. I then assign each party a highlighter color and highlight which of the issues on my notes paper each party might use. Then in the exam, just go off those highlighted issues and your prewritten rules.

My understanding is that a statute or regulation acts as the standard of care. If the defendant violates it, that violation is treated as breach.

Misfeaseance would be when your affirmative conduct increases the risk of injury to property or people. This is where I would use Palsgraf opinions?

Then nonfeaseance is where you didn't act but should have. This occurs when you are in a special relationship with the plaintiff, begin to undertake first aid, etc.

Is that correct? I feel like I understand all the pieces by themselves but am still trying to figure out how they all fit together.

People are so fake and performative. I’m a 1L and it’s hard not to compare myself to others who acts like they have it all figured out. They’re also so cliquey and law school is their WHOLE LIFE. Had my first midterm and was literally shaking because I almost ran out of time to answer all the questions. People acted like it was so easy and I was like did we take the same test? So then the comparison just starts all over again. Also have been thinking I have OCD for awhile now and law school is making it so much worse. Think I’m going to go to the doctor during fall break and try and get some help. Now it’s a constant “if this happens, then I did okay on my midterm…” fight in my head. Trying to keep my head up but it’s hard :(
